  2. Implemented Throughout The United States PURIFICATION FAR EXCEEDS DRINKING-WATER STANDARDS ESTABLISHED BY THE EPA Full Scale Implemented Facilities Projects in R&D, Planning or Demonstration NATIONAL OVERVIEW OF STATE POTABLE REUSE REGULATORY DEVELOPMENT

  3. Education is a Common, Key Component Examples of a local education program PRC and AIF have been leaders at State Level NATIONAL OVERVIEW OF STATE POTABLE REUSE REGULATORY DEVELOPMENT Purified Water Project Website https://www.jea.com/purifiedwater

  4. Regulatory Development Continuum • Most states start by permitting projects “case by case” • As technique expands, need for regulatory efficiency and surety for projects drives regulatory development • 4 Unique State Examples • California • Arizona • Texas • Colorado NATIONAL OVERVIEW OF STATE POTABLE REUSE REGULATORY DEVELOPMENT

  5. Typical Elements of State Programs • Source water characterization & source controls • Use of accepted advanced technologies, or Pilot Test • Microbial & chemical control technologies • Plans for Monitoring/Ops/Maintenance • Demonstration of Technical/Financial/Management Capability NATIONAL OVERVIEW OF STATE POTABLE REUSE REGULATORY DEVELOPMENT

  6. Special Thanks to … NATIONAL OVERVIEW OF STATE POTABLE REUSE REGULATORY DEVELOPMENT

  7. California – Prescriptive. • Specify performance, and technologies • Regs finalized for groundwater recharge (2014) • Regs finalized for Surface Water Augmentation (2018) • Developing DPR regs (expected 2023) • Agencies have lots of resources to study things • Need for projects understood, and growing demand, but… • Expensive and time consuming to implement NATIONAL OVERVIEW OF STATE POTABLE REUSE REGULATORY DEVELOPMENT

  8. Arizona – Collaborative • Need and practice understood • Potable reuse long time practice in Scottsdale • Lots of percolation like Florida • Recharge: Addressed under existing regulations. • Direct: Process underway to update Reclaimed Water Rules • Guidance Framework document finalized in 2018 • Utility/Academic/Consultant-based committee provided DPR recommendations • ADEQ will develop reg in conjunction with a proposed project NATIONAL OVERVIEW OF STATE POTABLE REUSE REGULATORY DEVELOPMENT

  9. Texas (Their own country) • Water rights – I’m above it, it’s mine • Recharge (Indirect) Projects • Practiced under existing regulatory structures • Direct Potable Reuse Projects • Addressed on a case-by-case basis by the Texas Council Environmental Quality (TCEQ) • No formal regs, and no plans for regs • “Texas DPR Resource Document” (2015) Guidance NATIONAL OVERVIEW OF STATE POTABLE REUSE REGULATORY DEVELOPMENT

  10. Colorado - Methodical • No proposed projects, but … • DPR outreach workgroup formed • Regulators, utilities, consultants, NGOs, Researchers • Have a long term process – implementing workplans for: • Framework Development • Public Engagement • Technical guidance • Will culminate in legislation/regulation NATIONAL OVERVIEW OF STATE POTABLE REUSE REGULATORY DEVELOPMENT

  11. Florida … ? • Growing need and growing interest • >50” rain/year = difficult to explain need to public • Multi-stakeholder framework developed • Permitting case by case right now NATIONAL OVERVIEW OF STATE POTABLE REUSE REGULATORY DEVELOPMENT

  12. SAFE • RELIABLE • SUSTAINABLE • DROUGHT-PROOF • ENVIRONMENTALLY RESPONSIBLE • COST EFFECTIVE • LOCALLY CONTROLLED
