CHARTER • The Competitive Metering Working Group (COMETWG) will establish the business policies and procedures to implement competitive metering services that will become available to commercial and industrial customers beginning on January 1, 2004, in the competitive retail electric market in Texas, as proposed under the Public Utility Commission of Texas (PUCT) Rule 25.311 • The working group will recommend a market structure and business policies and procedures necessary to implement other competitive metering services.

SCOPE • Implementation of Proposed Rule 25.311 • Develop a timeline for managing all activities related to the successful implementation of proposed Rule 25.311. • Define all market business processes necessary for market-wide implementation of proposed Rule 25.311. • Manage the process of developing the market-wide list of approved meters and file the final list within ninety (90) days of adoption of the rule. A solid draft of this list will be prepared for commission staff’s review by April 25, 2003. • Develop business requirements for any transactions changes necessary to implement proposed Rule 25.311, and deliver to TX SET according to timeline established for market business processes. • Work with TTPT and TX SET to ensure that timelines and coordination takes place for successful implementation of proposed Rule 25.311 by January 1, 2004.

SCOPE (continued) • Other Competitive Metering Services Market Structure • Recommend a market structure for implementation of other competitive metering services. • Develop a timeline for implementation of other competitive metering services. • Develop market business processes necessary to implement other competitive metering services. • Identify business requirements for transactional changes necessary to implement proposed market structure and deliver to TX SET according to timeline established for market business processes. • Work with TTPT and TX SET to ensure that timelines and coordination take place to ensure successful implementation.

APPROACH • The working group will meet as necessary. • The working group will give updates to the Retail Marketing Subcommittee at their monthly meetings and send PUCT staff reports on a regular basis on the progress of the working group. • The working group will develop teams assigned to each of the deliverables listed in the SCOPE. Each team will be responsible for assigning team leaders, timelines, goals, objectives, updates and reports. • TEAMS: Equipment/Hardware Business Processes for Implementation of Competitive Meter Ownership Other Competitive Metering Services

Team Leader: Steve Dwyer (Equistar) Draft list of approved meters and standards for meters & process for meter approval for PUCT staff review by April 25, 2003. Standards versus meter list Universal list versus TDSP specific list Define standards & testing requirements for meter approval Develop communication standards Develop process for new meter adoption Definition of meter: i.e. does it include supporting hardware such as PTs & CTs-Clarification per PUCT staff-meter does not include associated hardware. Meter inventory maintenance requirement-PUCT staff opinion: TDSP only required to install a replacement meter—not necessarily like-for-like Accuracy, security, programming, data integrity, & removal standards Develop process for implementing unique meter identifiers

Team Leader: Fred Strauss (AEP) Note: New PUCT Rule will define Commercial & Industrial Customers Define business processes, transactions, & affected entities Define ownership requirements Develop dispute resolution process Identify potential customer protection gaps Define minimum data requirements & needed protocol revisions Identify potential Tariff issues/gaps Identify potential Protocol issues/gaps Review existing processes/protocols Develop timeline for implementation of competitive ownership by March 28, 2003 Identify registration, certification & testing efforts

Team Leader: Denise Stokes (Competitive Assets) Develop high level view of market structure and timeline for all other competitive metering services by May 30, 2003 Review of ownership in relation to the other competitive services: Installation Removal Maintenance Testing Calibration Data Collection Data Management Performance Measures Certification & Testing of Service Providers Default Metering Services Inventory Requirements for TDSPs and Service Providers Data ownership requirements Define roles and responsibilities for each activity or service grouping identified above Develop market business processes and transaction requirements

TIMELINE • Kickoff Meeting 2-10-03 • Recommend Scope for approval by RMS 2-25-03 • Develop timeline for implementation 3-28-03 of all activities needed to implement PUCT Rule 25.311-submit to PUCT staff • Develop list of approved meters for PUCT 4-25-03 Staff review • Develop timeline and market structure for other 5-30-03 competitive metering services -submit to PUCT staff for review
