The Protection of Children from Sexual Offences Act, 2012 (POCSO Act) aims at protecting children from offences of sexual assault, sexual harassment and pornography to ensure healthy physical, emotional, intellectual and social development of the child. Even during the pandemic where virtual is the new normal, the abuse against children continues. 

  3. Significance of the POCSO Act The POCSO Act was enacted in 2012 and is gender neutral — it recognises that boys can be victims of sexual violence as well. It defines a child as someone under the age of 18. The Indian Penal Code does not recognise that sexual assault can be committed on boys.  

  4. When is POCSO Used Sections of the POCSO Act may be added by the police in the First Information Report (FIR) whenever a sexual offence is committed against a child. While special laws override the IPC, sections of both are often mentioned in the FIR. For instance, an FIR would book an accused under section 376 (rape) of the IPC as well as relevant sections of the POCSO Act.

  5. Online harassment is not a subject we are strange to. Although they are very common, the virtual mode has its complexities. Online harassment can be so varied that it is very difficult to put all of them under one umbrella. It can range from cyber-stalking to passing unwanted comments to sexualised bullying and so on. In the recent Bombay High Court Judgement, we saw that ambiguity still exists around something as simple as physical touch. Thus, this brings up the question of whether including online classes under the spectrum of the applicability of the POCSO Act is enough or not.
