Model Arrangement Discussion Group : Current Status of Initiative • Results of Discussions • Breakout Group included representatives from Australia, Bangladesh, China, EU, ICRC, India, Indonesia, Japan, Mongolia, Philippines, ROK, Russia, Thailand, UNOCHA, and USA • Responded to ARF Ministers August 2008 instruction to explore template feasibility and the July 2009 instruction for the ISM-DR to continue discussions. • Reviewed first draft of Model Arrangement in its entirety. • Recommended changes, additions, and improvements to Model Arrangement text

Model Arrangement Discussion Group: Objectives • Results of Discussions • Discuss conceptual framework for Model Arrangement. • Conduct line-by-line review of first draft of Model Arrangement • If possible, reach consensus on common principles and identify areas of divergence. • Recommend specific changes to Model Arrangement text. • Capture comments/concerns of particular interest to individual participants.

Model Arrangement Discussion Group:Key Areas of Agreement & Points for Further Discussion • Results of Discussions • Agreement: • Importance of Model Arrangement as mechanism for reducing response time. • Respect for sovereignty of Affected and Assisting States . • Mutually agreed nature of MCDA activities. • Peaceful nature of MCDA activities. • General applicability of Oslo Guidelines (with some concerns expressed). • Importance of uniform terminology and common understanding.

Model Arrangement Discussion Group:Key Areas of Agreement & Points for Further Discussion • Results of Discussions • Further discussion: • Scope of applicability (natural vs. manmade disasters) • Command & control over MCDA operations • Criminal jurisdiction (shared vs. exclusive), custody, detention • Individual member-nation concerns (e.g., quarantine, licensing, sovereign immunity of vessels & aircraft, limitations due to internal laws). • Carrying of arms by MCDA members • Adjudication and resolution of claims

Model Arrangement Discussion Group: Recommendations for Next Steps • Results of Discussions • Provide annotated text (including comments and edits) to ISM-DR co-chairs • ISM-DR co-chairs consolidate input, consider minor formatting changes to reflect differing views by ARF participants, and distribute revised draft of Model Arrangement to ARF participants. • Individual ARF participants consult with their governments, conduct further review and analysis by January 15 • Continue discussions of Model Arrangement through 2009-2010 Inter-sessional year. • Consider an additional review session of ARF civil-military disaster relief experts to further refine text following the receipt of comments by ISM-DR co-chairs in January • Recommend testing of Model Arrangement through next ARF Disaster Relief Exercise
