Exceptional ability = a degree of expertise significantly above that ordinarily encountered within the field. Lower standard than EB1A (Alien or Extraordinary Ability)

How to prove - “established record of achievement”

    30. ©2005 Paul Szeto LLC Tel: 732-632-9888 www.SZETOLAW.com 30 Evidentiary Guidelines for EB1 and EB2 Cases 1) Letters written by top experts are always good. 2) Letters that discuss past contributions or research results are better than letter that speculate on future prospective benefits 3) Specific examples are better than flowery words of praise. 4) Practical applications are better than new theories. 5) Examples of actual usage in the profession are always good.

All such workers require a labor certification, or Schedule A All Third Preference applicants require an approved I-140 petition filed by the prospective employer.

Must file a Form I-526, Immigrant Petition by Alien Entrepreneur Must invest between U.S. $500,000 and $1,000,000 In a commercial enterprise in the United States Creates at least 10 new full-time jobs for U.S. workers, not including the investor and his or her family.

A Group II More flexible than PERM – which requires recruiting from 6 months or less.
