Undocumented Students • HB 1403 (2001) • 77th Texas Legislature modified Texas Education Code • Provided in-state residency for undocumented students • Reside continuously in Texas with parent or guardian for 36-months leading up to H.S. graduation or GED • Sign an affidavit that the student would apply for permanent residency as soon as legally possible.

11. Undocumented Students • SB 1528 (2005) • 79th Texas Legislature further amended Texas Education Code • Extended the 36-month pathway to all U.S. Citizens, Undocumented and Documented • Sign an affidavit that the student would apply for permanent residency as soon as legally possible.

12. Undocumented Students • Affidavit required upon enrollment • Stipulates that Institutions are required document reminders to students each year enrolled of affidavit requirement and at graduation

13. Undocumented Students • In Fall 2013, an estimated 24,800 “Affidavit Students” were enrolled in Texas • Generating approximately $21.1M in Formula Funding

Undocumented Students • Residency Requirements • Reside in Texas 36-months prior to graduation from a Texas High School or receive a GED • And for 12 months prior to the census date of the institution of higher learning in which they are enrolling • Sign an affidavit that they plan to apply for permanent residency once eligible to do so • Undocumented and certain visa holders, including F-1 (Student) and H1-B (Work) visa holders meeting these stipulations.

Undocumented Students • Other Financial Aid • State Supported Grant Aid • State Authorized Loan Aid (College Access Loan) • Institutional/Other Financial Aid (Merit Aid, Institutional Discounts offered to residents) • Key Issue – Even with this aid, a gap in tuition/fees may still exist depending on the institution.
