    2. A Brief History of AB 3632/Chapter 26.5 2 Individuals with Disabilities Education Act, originally enacted in 1975 Continually reviewed and revised   34 CFR Section 300.34 – Related Services such as psychological and social work services

    3. Six Core Principles 3 Free Appropriate Public Education (FAPE) Appropriate Evaluation Individualized Education Program (IEP) Least Restrictive Environment (LRE) Parent and Student Participation in Decision Making Procedural Safeguards

    4. Prior to AB 3632/Chapter 26.5 4 Districts provided all special education and related services Districts had to evaluate and make placements for students with mental health needs Districts funded the costs of mental health services and mental health related placements

    5. Why the Change? 5 Class Action filed in December 1980 (Christopher T v. SFUSD et al.) Parents of special education children were systematically denied access to quality mental health services and therapeutic out-of-home placements for their children without surrendering them to the custody and control of the state Court decision in 1983 ultimately led to adoption of AB 3632 (Willie Brown) in 1984

CMH Responsibility under Chapter 26.5 6 County Mental Health Departments have been responsible for providing and paying for mental health related services for special education students 20,000 special education students receive mental health services County Mental Health Departments were to be reimbursed for 100% of their allowable costs not otherwise billable to insurance (e.g. Medi-Cal or private insurance)

    9. The October Crisis 9 October 8, 2010 – Governor Schwarzenegger signed the State Budget bill and line item vetoed all county funding for complying with the AB 3632 mandate.

    11. Success 11 December 8, 2010 – All districts in SELPA agreed to develop a Memorandum of Understanding April 2011 – Districts signed Memorandum of Understanding to provide services through FY 10-11
