  7. ADEQUACY IS ESSENTIAL • A compatible program that is not adequate is not acceptable

  8. COMPATIBILITY IS NOT ALWAYS ESSENTIAL • An adequate program that is not compatible still protects the public, workers and environment • How it is accomplished can vary

  9. AN IMPORTANT QUOTE ON COMPATIBILITY ‘B’ • “The Commission will limit this category to a small number of program elements…that have significant transboundary implications.”

  10. WHAT NEEDS ATTENTION • A clear and specific definition of “Significant Transboundary Implications”

  11. WHAT NEEDS ATTENTION • H&S related security has been part of the overall safety culture of the Agreement States since the beginning • Need to be careful in addressing additional safety in the adequacy and compatibility policy statement
