AHFSA Annual Conference Background Screening Interest Track August 4-7, 2019 MICHIGAN CHILD CARE BACKGROUND CHECK (CCBC) PROGRAM TIE-IN WITH NBCP Adam Krajniak, Manager Michigan Department of Licensing and Regulatory Affairs, Bureau of Community and Health Systems Workforce Background Check Unit

Objective: To share information about Michigan’s implementation of its Child Care Background Check program and the tie-in with the existing Workforce Background Check program. • Questions from interested States: Our conference goal is dialog. In this session, representatives from interested States are encouraged to ask questions; describe their challenges of effectiveness, efficiency and equity; and exchange information.

OVERVIEW • Lead Agency is Michigan Department of Education (MDE) • MDE receives over $204 Million from the CCDBG • $17 Million goes to Child Care Licensing Division within Department of Licensing and Regulatory Affairs (LARA) Child Care Background Check Program (CCBC) was combined with existing Workforce Background Check Program (WBC, 2006) unit for LTC/AFC providers in LARA Health Facility Licensing, Permits, and Support Division.

EARLY COLLABORATION 2015 – Collaboration began with MDE starting discussions on how to comply with CCDBG through statutory changes to meet: New fingerprinting requirements Definition of Staff Exclusionary Offenses • Lifetime • 10 year, 7 year, 5 year • Additions, eg, Human Trafficking as lifetime exclusion • Tiered exclusion system to move away from prior Good Moral Character standard

Collaboration with Michigan State Police (MSP) • Need for a new Fingerprint Reason Code • Changing and reviewing statutory authority for who would be printed (staff, unsupervised volunteers) • Reviewing and approving proposed language to comply with the FBI, including language for future FBI Rap back • Need for NCIC SOR check – provided on FBI response • Impact on MSP of 85,000 new fingerprints • Training on Hard Card Fingerprinting for Medically Fragile

  6. IMPLEMENTATION • 2017 – Legislation passed with near unanimous support, $5.5 Million approved by legislature to assist providers with printing of existing staff • Laws went into effect 3/28/18, deadline for printing 9/30/18 • CCBC web application developed by MSU/Yale based upon existing Workforce Background Check system • Provider based • MDE serves as License-Exempt provider • Analyst portal to process eligibility determinations • Consultant portal for Licensing Division

Utilized existing State of Michigan contract with fingerprint vendor IdentoGo by Idemia for reduced printing rate and special printing events MSU/Yale and Idemia coordinated use of Coupon Codes to pay for printing (fraud prevention) • Homes – 6 prints • Group Homes – 8 prints • Centers – 16 prints

CHALLENGES • Determining number of existing employees to be printed • Determining staffing requirements for CCBC unit (limited term positions) • Out of State processes Obtaining criminal history records from non- NFF states, CA/N checks • Contacted all other states to determine processes, fees, forms. Adapting to changes with these. • CCBC unit serves as pass-through for all out of state checks – not ideal but more timely and accurate. • CCBC system functionality and updates • Meeting the needs of multiple state agencies/divisions
