    2. Update Federal Labor Standard Act Federal Exemption for Computer Professionals Computer Tech List of Information Technology Jobs

The U.S. Department of Labor On August 23, 2004, the U.S. Department of Labor published revised regulations for the “white collar” overtime exemptions, including executive, administrative, professional, and outside sales positions under the Federal Labor Standards Act . The federal regulations on the professional exemption split that exemption into learned, creative and computer employees. Computer Professional Employees Are Exempt. Those employees who meet the definition of computer professional duties and pay requirements are exempt from the Minimum Wage Act and from payment of overtime wages

To qualify for the computer employer exemption, the following test must be met: Meets minimum salary or fee requirement of not less than $455 wk or not less than $27.63/hr if paid hourly Must be employed as a computer system analyst, computer programmer, software engineer, software developer or other similarly skilled worker in the computer field Employee must be highly skilled with a high degree of knowledge and ability to apply their knowledge and to use discretion and judgment in their duties.

The Employee’s primary duty must consist of : Applications of systems analysis techniques and procedures Design development, documentation, analysis, creation, testing or modification of computer systems programs The design documentation, testing or modification of computer programs related to machine operating systems

    6. HR Classification COMPUTER TECH Non-Exempt and subject to overtime pay at a time and one-half the regular rate of pay. Salary is broadband (BB2), pays from $11.95 to $ 99 dls, depending on market Requires a minimum of 4 year of experience or an Associate degree COMPUTER PROFESSIONAL Exempt position, no overtime pay Must meet exemption test Must be compensated on a salary basis at a rate not less than $455 per week It is a broadband (BB1), salary is based on market Requires a minimum of 8 years of experience or Bachelor degree or a combination of education and experience
