  2. School Injuries in Victoria • 20% of hospital ER presentations • 25% of hospital admissions • 131 / 100 000 under 15 require admission annually • 41% forearm fractures

  3. “In Loco Parentis” • The High Court of Australia determined that a school has a statutory obligation of duty of care "in loco parentis"

  4. “In Loco Parentis” • "Teachers have a personal duty to take reasonable care for the safety of students as well as the education authority's non-delegable duty to ensure that reasonable care is taken for the safety of students…"

  5. OH&S Legislation • The Vic OH&S Act 2004 requires an employer, to "provide and maintain so far as is practicable a working environment that is safe and without risks to health" and "to provide adequate facilities for the welfare of employees at any workplace…."

  6. OH&S Legislation • "provide and maintain" = a first aid risk assessment • "adequate facilities" = provision, maintenance and use of first aid equipment, facilities, services and suitably trained staff

  7. DE&T First Aid Policy • Participating in the risk assessment process - feedback from injury reports, first aid register data- identifying persistent or serious hazards • Providing input on first aid requirements for excursions

  8. Student Safety and Risk Management School council approval is required for: • Overnight excursions • Camps • Interstate visits • Excursions requiring sea or air travel • Excursions involving weekends or vacations • Adventure activities Principal approval for all single day excursions other than those above

Student Safety and Risk Management • Group Characteristics e.g. numbers\ratios, ages, known or unknown medical conditions • Environment e.g. terrain, weather conditions, flora and fauna • Location e.g. geographical isolation, sanitation, food, transport safety, hospital and medical support • Culture

First Aid Training • OH&S Legislation relevant to schools including "in loco parentis“ • OH&S management systems in schools • Materials relevant to student health and safety • First aid and risk assessments • First aid services in schools • Excursion risk assessment • Specific first aid skills
