For: TX • Texas is vulnerable to election fraud and lacks state prosecutorial powers to investigate and deter fraud. • The recent State v Stephens case has thrown our election integrity into jeopardy by determining that the Texas Attorney General, as a member of the executive department, cannot prosecute election integrity cases without a constitutional amendment. Given the time constraints, passing such an amendment is impractical. Additionally, neither the Democrats nor Republicans in the Texas House who voted to impeach Ken Paxton are likely to restore his prosecutorial power by statute in a timely manner.
