Here go the details for each type of Australia Partner Visa: Application to Partner Visa Outside Australia Application to Partner Visa Outside Australia Partner Partner Visa ( Visa (subclass subclass 309) 309) & Partner & Partner Visa ( Visa (subclass subclass 100) 100) To enter Australia and stay with your partner, you must apply for 309 partner visa. You must apply for this visa outside Australia. Also, you must be outside Australia when you are granted partner visa 309.
Partner visa (subclass 100) is a permanent visa which allows you to stay in Australia permanently. Before you are granted subclass 100 partner visa, you must have been issued subclass 309 partner visa. The advantage is you can file for both the visas at the same time, in one fee. You can be in Australia with your partner on temporary partner visa (309) while your permanent partner visa (100) is put for processing after 2 years from the date of application. You need to provide some additional documents proving continuity of your relationship and any other documents as required during permanent partner visa processing. If your relationship has been for long time, even before applying for visa, you will be granted permanent partner visa (100) immediately after the issue of temporary partner visa (309). When you are granted permanent partner visa (subclass 100) you can be either in Australia or outside Australia. Health and character requirements must be compulsorily met before you are granted partner visa. You can bring your child along with you on additional fee. Prospective Marriage Prospective Marriage Visa ( Visa (300) 300) This visa allows you to marry your fiancé, who is an Australian citizen or Australian Permanent Resident or an eligible New Zealand citizen. The validity of this visa is for 9 months. Before the visa expires you must apply for partner visas under subclass 820 & 801 in Australia. You must be in Australia while applying for this visa and when the visa is granted.
Partner visa under subclass 801 is permanent visa which allows you to stay in Australia for indefinite period. You may or may not be in Australia when permanent partner visa (801) is issued to you. As with above partner visas, applied outside Australia, you can apply for both partner visas, 820 and 801 at the same time in one fee. After 2 years of lodgement of 820 partner visa, you will be eligible to be granted 801 partner visa. If your relationship is for long term, you can be granted 801 partner visa (permanent) immediately after granting of 802 partner visa (provisional). Under 820 partner visa, you can apply for bridging visa, if your provisional visa is nearing expiry and you have not yet granted 801 partner visa. If you have applied for any visa before, and it is refused or cancelled, you cannot apply for partner visa under subclass 820. Your dependent children can be included with your visa application on additional fee. Under all the partner visas you must be sponsored by your partner and can study, work and live in Australia for the time specified in your visa.
