ENERGY EFFICIENT PROCUREMENT • All state purchases also have to be made in accordance with 200 KAR 5:330, which establishes minimum recycled content for certain products, including construction materials, paper, foam, metals, oils, etc. which are purchased by state government. • Finance administrative purchasing policy (FAP) 111-21-00 notes: It is in the best interests of the Commonwealth to procure energy-efficient and cost-effective products. Therefore, when purchasing energy-consuming products, all state agencies authorized to procure such products shall include Energy Star labeling, as designated by the federal Department of Energy and Environmental Protection Agency, as one of the best value scoring criteria. • All new contracts require that information technology equipment, such as computer hardware, multi-functional devices, and printers, are energy star compliant. • Finance Purchasing also includes “Energy Star” requirements in solicitations for other “energy-consuming products”, when appropriate, in order to identify and purchase energy efficient products. For example, we recently completed a solicitation to purchase almost $500,000 in energy-efficient kitchen equipment. • Finance Facilities is also looking at the possibility of making modifications to some of our existing buildings to convert them to Energy Star buildings.  To be classified as Energy Star, a  building must be in the top 25 % of buildings of its type for energy usage.

OTHER REQUIREMENTS • Other examples of contract models which assist with responsible green purchasing: • Recycled paper program: Master Agreement with a vendor, who purchased used paper from state agencies (through EPPC) and recycles such materials. • Used tires: Master Agreement with a vendor (on behalf of the Division of Waste Management) to manage and dispose of tires statewide, through the Waste Tire Amnesty Program. • Janitorial Supplies Master Agreement: This contains items that are Green Seal Certified.* Green Seal Certification is supposed to ensure that a product meets rigorous, science-based environmental leadership standards. • Master Agreement for battery-electric vehicles. • eScrap RFP (currently in process): Finance and COT are working on establishing a contract for pickup and recycling services for end-of-life electronic equipment and components. These services must be provided in compliance with hazardous waste, processing, security, sanitization, and exporting requirements.

  4. FACILITIES RELATED PROCUREMENT • Energy Savings Performance Contracting Program: This program evaluates the systems, buildings and operations of an existing facility or campus and identifies areas where new technology or changes in operations could result in a savings in utility costs.  Once those savings are quantified, new equipment is purchased and paid for with the savings it generates.  This has been a very successful program and has generated self-funded projects in excess of $50,000,000. • Mechanical Life-cycle Cost Analysis: The Division of Engineering and Contract Administration requires a life cycle cost analysis on all of the mechanical systems that it purchases for construction projects.  This analysis looks at the energy used by mechanical systems and the costs associated with that energy.  The Division then looks at the initial purchase price, operational costs, and life expectancy of the equipment and makes a decision based on the best value life cycle costs.

  5. NEW INITIATIVES • House Bill 2, passed during the 2008 Regular Session will bring about some changes in construction procurement. House Bill 2 sets up a committee to develop high efficiency building standards.  Once those standards are established, all new buildings will have to be built according to those standards.  • House Bill 2 will also establish requirements to perform energy audits to address demand side energy efficiencies.
