When any law enforcement agency is knocking on your door, sound judgment and awareness of your constitutional rights can facilitate you making the correct decision prior to opening up your door. Never open your door, unless the law enforcement agency identifies themselves (provides valid badges) correctly and articulates that they have a warrant. If so, comply with opening the door and immediately request to view the purported warrant. If there is no warrant, never open your door to any law enforcement agency. This right is incorporated in the Fourth Amendment to the U.S. Constitution. The Fourth Amendment does not allow unreasonable searches of personal property. The Fourth Amendment demands that warrants must be issued only upon a possible cause. The place to be explored must be identified, and the person/thing to be confiscated must also be specifically defined. Police Cannot Search Your Premises Without a Warrant Typically, the police may use the phrase “if you have nothing to hide, open your door and allow us to conduct a search.” Do not be intimidated. Politely turn down this request. You have a constitutional right to privacy and to be free from unreasonable searches and seizures. Additionally, you can request that the police remove themselves from your private property and that they do not have your authorization to be on your
