  1. Portland Cement Zambia factory has touched three major legal systems of Zambia

  2. These are Lusaka High Court, higher Court of Appeal and the Supreme Court Zambia

  3. The Lusaka High Court gave a controversial decision by announcing Ventriglias as only shareholders

  4. It was refuted and reversed by the higher Court of Appeal

  5. The higher Court of Appeal announcement was made on 31st January 2019 by justice Mwinde

  6. The court announced Dr. Rajan Mahtani as the majority shareholder and legal owner

  7. After more than 1.5 years of this court verdict, it was challenged by the Ventriglias

  8. The claim by the Ventriglia family was made at the Supreme Court Zambia

  9. The Supreme Court established a bench of three SC judges for evaluating the claim

  10. The Bench comprised of justice Mumba Malila, Justice Royda Kaoma and Justice Michael Musonda

  11. Together, the judges found significant discrepancies in the claim by the Ventriglias

  12. Law requires any claim against previous court decision to be made within 14 days of the court verdict

  13. This means the timeline for submission of claim was middle of February 2019

  14. The Ventriglias, however, submitted their claims after more than 18 months

  15. Furthermore, the claim was controversial without any evidentiary support

  16. Together, the Supreme Court Bench looked into the validity of the claim and found it compromising

  17. As a result, the claim by the Ventriglia family was rejected
