Why it is time to regulate online gaming and fantasy sports in India The Union Information & Broadcasting Ministry issued an advisory last week to all private television channels, asking them to diligently follow the guidelines issued by the Advertising Standards Council of India (ASCI) on November 24, 2020. The guidelines issued by the ASCI are aimed at ensuring that all communication done via online gaming advertisements is transparent & safeguards the consumer while helping prevent unlawful activities. The guidelines will become effective from December 15. Once they become effective, real-money gaming platforms won’t be able to advertise via ads replete with affirmations of winning big money in gaming jackpots. The ASCI guidelines make it necessary for online gaming advertisements to make users aware of financial & other risks linked with playing online real-money games. Moreover, the advertisements should also not showcase real-money online gaming as an income opportunity or alternative employment option. The advertisements also won’t be able to showcase in any way that users playing these games are in any way more successful as compared to those not playing them. The guidelines also necessitate that advertisements shouldn’t showcase users below the age of 18 or those who resemble to be below 18 years, playing on real-money online gaming platforms for winnings.
