Special Education Working Group The purpose and goals are: • To clarify existing applicable laws and regulations regarding school facilities for the education of students with exceptional needs. • To assist the CDE with considerations towards, and development of, a procedure for the CDE to use in evaluating plans for buildingsthat house students with exceptional needs. This procedure will include: the proposed construction of new non-integrated sites; additions to, and the modernization of, existing non-integrated sites; and additions to existing integrated sites. Furthermore, effort will be made to identify best practices in providing special education facilities.

Special Education Working Group Membership includes representatives of: • Districts — Special education and facility staff • County Office of Education — Special education and facility staff • California Department of Education — Special education and facility staff • Special Education Local Planning Areas • County School Facility Consortia • Coalition of Adequate School Housing Quarterly meetings in 2010

  8. Special Education Working Group Outcomes • Draft process and procedures for consideration of non-integrated projects • Identified disconnects between program and facility funding model • Best practices

Special Education Working Group Procedure Overview: • Discussion of why facility is needed with consideration of: - Continuum of placement - Peer group interaction and LRE - Transition plan for students to the general population - Placement on general education site • CDE Special Education and Facility staff review and may request additional information from District/COE. • If CDE does not approve, District/COE may request hearing before Special Education Advisory Committee. • Approval of the Superintendent of Public Instruction. Next Steps: - November meeting working group to adopt final process

Qualified School Construction Bonds (QSCB) Overview • Tax-credit bonds created by ARRA – no new funding, simply tax credits for bonds issued • QSCB defined as: • 100 percent of proceeds used for • Construction, renovation or repair of public school facility • Acquisition of land for facility to be constructed by QCSB • Issued by state or local government • States may directly issue bonds on behalf of local eligible schools • US Department of Treasury issued guidance and allocations Notice 2010-17

Qualified School Construction Bond Tax-Credit Authorization • US Department of Treasury and US Department of Education announced $11 billion in allocation authority on March 17, 2010 • 2009 authorization for California was $1,355,491,000 • 2010 authorization for California is $1,266,626,000 • In 2010 $546,568,000 was federally allocated to twelve large California school districts

Qualified School Construction Bond 2010 Legislation • Assembly Bill 2560, (Brownley) Chapter 266, Statutes of 2010. • Legislation provides authorization, process and criteria for allocation/issuance of 2010 QSCBs to the CDE and CSFA. • $720,058,000 in federal tax volume cap for state allocations

Qualified School Construction Bond 2010 CDE Allocations • $651,652,000 will be allocated to LEAs by the California Department of Education • $214,753,658 rollover of 2009 allocations • $866,405,658 total CDE to allocate in 2010 • $68,406,000 will be allotted to the California State Treasurer, California School Finance Authority to assist charter schools

Qualified School Construction Bond 2010 CDE Administrative Process Minimum – Maximum • No minimum for bond authorization • Maximum of $25,000,000 authorization per school district or county office of education Applications • Application posted to CDE’s website on October 1, 2010 http://www.cde.ca.gov/ls/fa/qs • Applications will be accepted by certified mail only and may not be postmarked prior to November 5, 2010. Any applications postmarked prior to this date will be returned. NO OTHER FORM OF DELIVERY WILL BE ACCEPTED.

  16. Qualified School Construction Bond 2010 CDE Administrative Process • Applications will be accepted on a first come, first served basis until the state’s allocation is fully committed. • Districts or county offices of education that received a 2009 authorization but did not issue may apply nine months after enactment of legislation (June 24, 2011). • Districts that received a direct allocation from the U.S. Treasury in 2009 or 2010 are not eligible to apply for the state program.

Qualified School Construction Bond 2010 CDE Administrative Process Application Criteria: • The projects will be funded by voter approved bonds or bond anticipation notes as authorized by California Education Code Section 15150 • Except small districts (enrollment of 2,500 or less) and county offices of education

Qualified School Construction Bond 2010 CDE Administrative Process Unused Authorization: • Issuance must occur within six months from date of allocation or the authorization automatically reverts back to the State (CDE) • No extensions will be provided • CDE will reallocate to 2010 eligible applicants • At the completion of the expenditure of the bond issuance a completion report will be submitted to the CDE and certified by LEA bond counsel

  19. Qualified School Construction Bonds (QSCB) Oversubscription: • If the program is oversubscribed the order of authorization shall be established using the following criteria: - First, postmark - Second, DSA approved project(s) - Third, percentage of free and reduced lunch enrollment

  22. Internet Application for Plans and Sites (IAPS) Objective: • Institute a web-based application and plan submittal process • Improve customer service by accepting applications and plans electronically through the Internet • Improve overall staff efficiency and reporting capabilities

  23. Internet Application for Plans and Sites (IAPS) Process: • Stakeholder input • Feasibility Study Report – Final October/November • Procure system solution • Test with stakeholder involvement • Fully implement - 2012

Pipeline Protocol • California Education Code 17213 - Prohibits acquisition unless school district determines site does not contain hazardous pipelines (natural gas serving the school excluded) • Title 5 Section 14010 (h) - Site within 1,500 feet of a high pressure pipeline must prepare analysis of associated risk - 2007 CDE updated protocol • Probability • Consequences
