  1. Know Who Gets Child Custody in the UAE The legal system in the UAE is so comprehensive that it covers most, if not every aspect, of the daily lives of the people living here. It is meant to protect every resident; local or foreign. That said, certain areas can be complex when dealt without legal counsel. One of these is child custody in the UAE. Like child custody laws in other countries, it has the best interests of the child. However, mothers and fathers have specific roles assigned to them, and the differences are often noted when you go over the descriptions of custodians and guardians. Knowing the difference can help you understand who is qualified for custody of your children should you and your spouse get a divorce! Definitions to know Under laws of child custody in the UAE, the guardian is the individual who can financially maintain the child. This person is responsible for making important decisions on the child’s upbringing and education, and takes care of all affairs of the child. On the other hand it is the custodian who is merely concerned with the day-to-day life of the child. That said, it is the custodian who has the actual physical custody of that child, and therefore, they are responsible for caring, raising, and bringing up the child. There is no definitive separation between the guardian and custodian, as a parent can be made to play both roles. Usually, the mother gets the custody and the father is the guardian. However, the decision will still depend on the best interests of the child. Who gets child custody? The mother is typically the one who gets child custody in the UAE, but only if the courts see her as someone who is fit to care for and raise the child. Whoever becomes the custodian must fulfill a set of obligations and be of sound mind, be capable of raising the child, mature, honest, not sentenced to any serious crime, and without any infectious disease. Certain laws may also specify that the custodian and the child must share the same religion, but ultimately, the court will rule in favor of the child’s best interests.
