He named <br><br>several contracting officers who assured that had not received <br><br>any initial or revised quote from Latvian Connection LLC either. <br><br>Only to admit that error was made on their end by overlooking <br><br>the fact that Mr. Elmore, who attended a three-week course in <br><br>US had been the Contracting Officer and confirmed that he had <br><br>received the initial quote on time and had inappropriately <br><br>received the revised quote, late.

Declaration of LTC PHILLIP W. CHRISTY GAO Bid Protest B-411489 I, LTC Phillip W. Christy, declare as follows, pursuant to 28 U.S.C. § 1746; 1. I currently serve as the Commander and Director of Contracting of Regional Contracting Center -Kuwait (RCC-KU), as well as Contracting Officer. Regarding GAO Protest B-411489, I previously rendered a Contracting Officer statement mistakenly to the effect that RCC-KU had not received an initial or revised quote from Latvian Connection LLC in response to solicitation W912D1-15-R-0014 Canopies which was conducted using FAR Part 13 procedures. 2. I made the Contracting Officer statement because MAJ Brooks, identified as the Contracting Officer by Amendment 0004 to the solicitation, was executing a contingency contracting requirement in support of Operation Inherent Resolve. The Contracting Specialist, Mr. Mohammed Haque, assured me that he had not received any initial or revised quote from Latvian Connection LLC. MAJ Brooks also informed me had not received any quote from Latvian Connection LLC. Both the statements by Mr. Haque and MAJ Brooks are still true. However, at the time I submitted the Contracting Officer statement in support of a motion for summary dismissal of the protest, we overlooked the fact that Mr. Elmore who was sent to the United States to attend a three-week course initially had been the Contracting Officer and might have received a quote from Latvian Connection LLC. As soon as Latvian Connection LLC replied to the GAO that it had sent its quotes, and provided the emails that had carried those quotes, we saw Mr. Elmore was an addressee and confirmed that he had received the initial quote on time and had inappropriately received the revised quote, late. I had my legal counsel notify the Government Trial Counsel immediately, on 14 May, about the error we had discovered. Executed on 2 June 2015 at 1743hrs (Kuwait Local Time) PHILLIP W.
