AIR POLLUTION CONTROL DISTRICT Planning, Rule Development, and Monitoring Imperial County air quality attainment plans Develop Rules and Regulations for State and Federal mandates Monitor the air quality Record air quality at 5 locations in the County ( 4 under APCD ownership) Compliance Manage and oversee the Agricultural Burn Program 279 Agricultural Burn Permits 65 Open Burn Permits Engineering Write and review permits (7 – Title V, 3 – SM, 896 total permits) Administrative Manage Incentive program to reduce agricultural burning Manage an incentive grant programs to reduce diesel engine emissions
ICAPCD PLANNING ITEMS PM10 In July 8, 2010 US EPA’s finalized its ruling of a Limited Approval and Limited Disapproval of the Regulation VIII Rules. (40 CFR Part 52 Vol. 75 No. 130) PM10 BACM Rule lawsuit settlement with EPA reached and approval of Final rules in Federal Register on 04/22/13 PM10 SIP will be based on years 2013 -2015
ICAPCD PLANNING ITEMS 8-HOUR OZONE 1997 standard On February 13, 2008, IC reclassified as a “moderate” non-attainment area December 3, 2009 US EPA found that the IC “moderate” non-attainment area attained the 1997 8-hr NAAQS for Ozone. December 21, 20 CARB formally submitted to the US EPA the IC 8-Hour Ozone AQMP and the RACT SIP 2008 standard On May 21, 2012 IC classified as a “marginal” non-attainment area. Attainment date is December 31, 2015. To comply with EPA requirements of the Ozone SIP, Regulation VIII 2 rules had to be adopted and 3 rules revised
ICAPCD PLANNING ITEMS PM2.5 State Implementation Plan EPA designated the Imperial County urban areas as non-attainment on 12/14/2009. The SIP also requires all other applicable requirements be achieved. The PM2.5 SIP is required to be submitted to US EPA by December 14, 2012. The Air District will be submitting a “But For” SIP.
RULE DEVELOPMENT Newly Approved and Amended Rules REVISED Rule 101 Definitions Rule 206 Processing of Applications Rule 207 New and Modified Stationary Source Review NEWLY PROPOSED Rule 400.3 Internal Combustion Engine(s) Rule 400.4 Emissions of Oxides of Nitrogen from Wallboard Kilns The revised rules and the Newly Proposed Rules were adopted by the Air Pollution Control District Board of Directors on October 22, 2013
ICAPCD INCENTIVE PROGRAMS Incentive Programs Carl Moyer 14th and 15th year in Carl Moyer , estimated $661,550 – 28 replacements 14th year (now), estimated $350,000 – 14 replacements Prop 1B Goods Movement Year Four, $6.1 m (approx. 122 replacements)
ICAPCD PROGRAMS Rule 310 Mitigation Project Funding Adopted November 11, 2007 2012/2013 fiscal year–1 PM10 project was funded $101,500 for school soccer field parking lot paving project New RFP commenced August 1, 2013 and ended October 1, 2013. Available funding for 2012/2013 fiscal year: Ozone – $471,504.00 PM10 - $300,394.00
ICAPCD BORDER ITEMS Air Quality Task Force Grant Grant Amount of $1.25 Million for 5 years . However, it subject to annual Federal budget re-appropriation. The new 5 year grant is for the continuance of the Air Quality Task Force as well as Rule Development and Special Projects. Special Project Grant: Grant Amount of $35,000 The Border Environmental Cooperation Commission (BECC) gave a pre-approval for a 24 month grant for an Environmental Education Campaign in Mexicali. The Grant consists of educational information through the media, television and radio. The objective is to generate a change in attitude in the community with respect to caring for the environment and the air quality in the region, Educate the community in regards to the status of air quality and the consequences of open burning of tires, wood, fireworks, etc. specially during the Holiday season. BECC Grant Pending is the approval of $58,8000 grant fund for the project “Vehicle Idling Emissions Study at Calexico WEST Port of Entry” .

ICAPCD MISC. ITEMS (cont.) • Exceptional Events Rule • May 10, 2013 – EPA released revised Interim Guidance document – still many issues • Sept. 9 2013 – Senator Flake (Az) town hall meeting on EE. • Senator plans to reintroduce legislation to simplify and streamline the EER.
