ONWEC Arbitration CommitteeBackground • ONWEC has encountered conflict situations in the past • Conflicts proved to be dysfunctional • ONWEC Governance recognized need for a formal process • Committee was formed to create Terms of Reference
ONWEC Arbitration CommitteePurpose • To act as a 3rd party to resolve conflicts between: • members of ONWEC • Members of ONWEC and NW Coordinators • NW Coordinators and members of the OPS • ONWEC and its Partners, on process issues or interpersonal issues between the various members
ONWEC Arbitration CommitteeMembership • Comprised of the following; • Chairperson of the AC – Standing Member • NW Business Owner – Standing Member • 3 elected ONWEC members as volunteers • to be selected by the Chairperson as neutral to the issue or complainants involved • will be selected by the Chairperson of ONWEC only when Chairperson of the AC is in a conflict of interest
ONWEC Arbitration CommitteeConflict Definition • a member fails to comply with rules and decorum of ONWEC • a member disagrees with direction of a sub-committee and is unable to get a satisfactory response to the issue • problem with direction of NW activities within a CPC and efforts have failed to solve locally • integrity of NW program has been put into question • personality conflict between members that cannot be dealt with impartially by a Chairperson
ONWEC Arbitration CommitteeProcess • Initiation can be a written or verbal request, directly to the AC Chairperson • AC will be called to decide on merits of proceeding further • Affected parties will present their arguments (however not necessarily at the same time), either verbal or supported with print material • Each party has the burden of providing facts to support their case • The AC will focus on getting a result, which may not necessarily be to the agreement of the parties involved • ONWEC Chairperson will receive the AC decision and AC recommendations are considered binding • ALL AC PROCEEDINGS ARE HELD IN CONFIDENCE AND WILL NOT BE DISCLOSED TO THE ONWEC BODY AT LARGE
