Moving Forward (non-grant) task within ASSIST, districts will run a new diagnostic for assurances on this policy.  In addition, a copy of the policy, board meeting minutes, and the certifications document (with signatures) must be uploaded into ASSIST. (A how-to guide is available in the resources section of the Raising the Compulsory Attendance web page. • NOTIFICATION TO KDE Districts must submit an e-mail stating completion of the process via e-mail to KDE atSB97@education.ky.gov. • PASSAGE For any districts that have not adopted a district-wide policy to raise the compulsory attendance age from 16 to 18 to date, the local board must do so with implementation beginning no later than the 2017-18 school year.  However, note that unless the adopted policy specifically states it is not going into effect until 2017-18 or another intervening year, the policy will go into effect in 2015-16 for that district.  • VERIFICATION Districts must verify the passage of the policy.  Using the KDE Compulsory Attendance (SB97)

4. Timeline for 2013 ReportingAlldates are tentative. • Individual student data released first in PearsonAccess • August 2 - K-PREP individual test scores (Novice, Apprentice, Proficient and Distinguished (NAPD)) (all subjects grades 3-8, writing at grades 10-11) • August 16 - Individual student reports with student growth percentile Note: EOC individual scores (i.e., scale scores) already reported. KDE will provide NAPD cuts for the multiple-choice scale.

Timeline for 2013 ReportingAlldates are tentative. • Schools and districts will have the opportunity to review student data for accountability and demographics before public reporting. • August 14-27 - Data review and cleanup in SDRR • September 12 - DAC training and Quality Control day for system issues • Week of September 23-27 - Public release of accountability reports via the School Report Card

29. 704 KAR 7:160, Use of physical restraint and seclusion in public schools – effective 2-1-13 • Requires all school personnel to be trained annually to use an array of positive behavioral supports and interventions to increase appropriate student behaviors, decrease inappropriate or dangerous student behavior and respond to dangerous behavior • Issued recent clarification regarding the “all school personnel” training requirement indicating anyone performing a function that would typically be performed by school employees is included in “school personnel” and must receive the required training. This means personnel working in the school setting on a regular basis. • Regulation questions: Gretta.Hylton@education.ky.gov • Technical questions: pd@ket.org or (800)-432-0951

30. Regulations Likely to Become Effective in First Semester 2013-14 • 702 KAR 4:160, Capital Construction Process • Updates AIA forms and Kentucky specific AIA forms in new regulation • Retains the 2007 regulation’s minimum 30-year requirement for a major renovation • Includes the 2010-2011 Facilities Work Group’s (superintendents, district facility directors, and architects) recommendation to increase the gross square footage percentages from 110% to 115% for elementary schools and 115% to 120% for middle and high schools to provide districts flexibility in their school construction planning • Does not include construction delivery methods in the regulation, such as the construction manager at risk and the construction manager as constructor; can be requested and approved by the regular KBE waiver process under KRS 156.160(2) • Will provide general guidance and information on alternative delivery methods to all school districts • Will provide individual guidance and support to those districts seeking to use alternative delivery methods

31. 702 KAR 7:065, Designation of agent to manage middle and high school interscholastic athletics • Adds the following for middle school interscholastic athletics effective 2014-2015: • Creates a permanent middle school athletics advisory committee • Places coaching qualifications (21 years of age, criminal background check, high school graduate) in regulation congruent with KRS 161.185, particularly for non-faculty (paraprofessional) coaches • Requires a standard medical examination for a middle school athlete • Applies high school sports medicine policy requirements to middle school (heat index and heat illness, wrestling weight management, and concussion and other head injury policies) • Requires financial documentation from organizations conducting school-based events at the middle school level • Requires KHSAA to provide information about Title IX resources and seminars to middle schools • Requires schools not to play retained student when playing interscholastic (school vs. school) competition • Facilitates middle schools’ monitoring compliance with the sports safety requirements of KRS 160.445

32. 702 KAR 7:065, Designation of agent to manage middle and high school interscholastic athletics (cont’d) • Adds the following for middle school interscholastic athletics effective 2014-2015 (cont’d) • Requires schools/districts/conferences or associations to develop rules and limitations for student participation (age limit, students below 6th grade, practice time limits not to exceed the high school limits, scrimmage and game limits not to exceed the high school limits) • Applies Open Meetings requirements to middle school athletics • Allows common middle schools to only play interscholastically against schools that adhere to the same restrictions • What the regulation does NOT do: • Does NOT envision the conducting of statewide championships by any regulatory entity • Does NOT require that any middle school eligibility rule “look like” high school rules • Does NOT require that all competitors on a team be from same school; those decisions to be made locally • Does NOT require that school teams ONLY play school teams and in school events; those decisions to be made locally
