Office of Telecommunications and Post Regulation • Legal basis – the Telecommunications Law of 21 July 2000 • Originallyestablished as the Office of Telecommunications Regulation -1 January, 2001 • On the basis of amendments to the Telecommunications law, from 1 April 2002 - the Office of Telecommunications and Post Regulation
Scope of responsibilities • Spectrum management & control • Telecommunications market regulations • Postal market regulations • Market surveillance (EMC and RTTE directives)
Transposition of the new regulatory framework (1) • In Poland the process of implementation of EU Directives of 2002 started at the end of 2003 (amendment to the law of 2000) • The New Telecommunications Act of 16 July 2004 came into force on the 3rd of September 2004
Transposition of the new regulatory framework(2) • The provisions of the new law fully compatible with the requirements of EU Directives of 2002 • The new act will be accompanied by all the necessary ordinances (36 obligatory and 16 optional); so far 5 regulations have been issued by the Minister of Infrastructure and 1 by the National Broadcasting Council
Transposition of the new regulatory framework (3) • The implementation of the EU Directives into the national law is: • necessary from a formal point of view – requirements of the EU membership • necessary from a market point of view – further liberalisation of the market which implies: competitive market, consumer satisfaction, infrastructure development
Transposition of the new regulatory framework (4) • Operators’ expectations concerning URTiP activities: • growth in regulatory effectivness • improvement in URTiP’s bureaucratic procedures • more effective counteraction to TPSA’s monopolistic practices
Transposition of the new regulatory framework (5) • In accordance with the new framework the regulatory authority in Poland plays the central role as regards the regulation of the telecommunications market • Its competencies encompass: market analysis, SMP designation, regulatory measures’ imposition, frequency management, numbering allocation
Market analyses • Ordinance on the designation of relevant markets enters into force on 24 November • Schedule of market analyses has been settled • Questionnaires for operators have been prepared
Telecommunications market in Poland (1) • Market value – PLN 41,5 bn. (14% growth in 2003): fixed-line: 15,9 bn., mobile: 15,3 bn., data transmission: 2,7 bn. • Fixed telephony – 88 operators (local: 20, DLD: 8, ILD.: 8, VOIP: 50-80 operators), 12.3 m lines (33% penetration rate) • Mobile telephony – 3 operators, 19,6 mln subscribers (51% penetration rate) • Licenses for 20 Mobile Virtual Network Operators have been issued (not operating yet)
Telecommunications market in Poland (2) • Internet – 7,8 million users (penetration rate: 25%, 2,2% broadband, 80% growth over last year), • 830.000 of broadband users – 185.000 represented by subscribers of CaTV, 340.000 by subscribers of the incumbent operator, 290.000 LANs at homes

Regulatory Objectives for the President of URTiP for 2005 (1) • Making frequencies for UMTS and DCS available to operators selected in the course of a tendering procedure • Full execution of subscribers’ rights with respect to the possibility of choosing a provider of publicly available telecommunications services – network digitilisation completed • Execution of subscribers’ rights with respect to number portability when changing an operator
Regulatory Objectives for the President of URTiP for 2005 (2) • Elaboration of a concept for the provision of universal service; instituting proceedings for a competition in order to designate an undertaking with universal service obligation • Conducting telecommunications market analyses – publishing a report on the market; collecting data necessary for designating SMP operators on individual relevant markets and imposing regulatory obligations
Regulatory Objectives for the President of URTiP for 2005 (3) • Increasing availability of information on the principles of telecommunications service provision, basic rights and obligations of subscribers of publicly available telephone services – performing statutory tasks of the President of URTiP laid down in Article 62 of the Telecommunications law • Verification of TP S.A. reference interconnection offer after charges for services of an SMP operator are set using cost calculation results and regulatory accounting • Introduction of reference offers for leased lines and access to the local loop (1st quarter of 2005)
