As a US immigration lawyer, Ajmera Group has consulted several businesses to immigrate to the US in a business objective. It is to note that there are various types of business visas for the US but in this blog, we will throw light on the EB 5 Visa or the million-dollar Green Card. The EB 5 Visa In the ’90s, the residency by investment plan was brought forward by the US government. It is open for immigrants who want to invest in new businesses that will open a minimum of 10 opportunities for employment. It is also referred to as the USA Immigrant Investor Program (USA IIP). Classification of EB 5 Visa Under the umbrella of the EB 5 visa, there are three possible ways of investing in the US. 1.Create a new commercial enterprise 2.Invest in troubled businesses 3.Invest in a regional center

  2. Create a new commercial enterprise Rightly coined as the million-dollar Green Card, the applicant must invest a minimum of $1,050,000. However, if the investment falls within the TEA (Targeted Employment Area - a rural area in the USA with high unemployment) then you are required $800,000. The criteria for investment are as follows: ●The investment must benefit the U.S. economy in the form of commodities and employment. ●At least 10 full-time job opportunities must be created for U.S citizens, Green cardholders and other people permitted to work. This condition does not include the family of people being employed. ●The applicant is required to be actively involved in business management and policy. Troubled business The applicant can invest in a troubled business that has existed for at least 2 years. The criteria are as follows: ●Investment can be made in a business recording net loss for 12 to 24 months before the submission of Form I-526. The loss for this period should be equivalent to the net worth of the business before the loss. ●The minimum number of jobs must be maintained for 2 years. ●Active involvement of the applicant is required in the management of the business. ●The TEA criteria remain the same for troubled business investment. Regional center As an EB 5 immigration lawyer, we have seen a majority of businesses applying for a regional center investment approach. The application criteria for the regional center are as follows: ●The applicant must make an investment of $800,000 or $1,050,000 in a USCIS regional center in association with a new enterprise or a troubled business.
