Workshop Purpose • Present/Discuss current and new approaches to estimate streamflow and water availability in ungaged streams • According to the CA Water Code, streamflow and water availability estimates are needed before the SWRCB can grant a water right permit. • Streamflow estimates are needed by Caltrans and DWR to design and operate water-related facilities

  3. Water Code Requirements • Every water right application submitted to the SWRCB must include “[s]ufficient information to demonstrate a reasonable likelihood that unappropriated water is available for appropriation.” (Sect. 1260(k)) • Before the SWRCB can grant a water right permit, it must find that there is “unappropriated water available to supply the applicant.” (Sect. 1375(d))

  4. Water Code Requirements, cont. • The use of water for recreation and preservation and enhancement of fish and wildlife resources is a beneficial use of water.” (Sect. 1243) • “In determining the amount of water available for appropriation, the SWRCB shall take into account, whenever it is in the public interest, the amounts of water needed to remain in the source for protection of beneficial uses….” (Sect. 1243.5)
