  2. WHYis the delivery of telecommunications services different? • Historically provided by private companies, not governments

  3. WHY is it difficult to reconcile tribal sovereignty with telecom policy • Jurisdiction is split between the federal government (interstate communications) and state government (intrastate) – where is there room for Tribes?

  4. HOWhas the FCC dealt with Tribes? • 2000 Policy Statement recognizing Tribal sovereignty and recognizing trust relationship • Establishment of ONAP in 2010 • Requiring “Tribal Engagement” by carriers receiving USF support

  5. Whatregulatory challenges do Tribes face? • Initial capital to build telecom systems • Sustainability • Changes to USF High Cost Support • Changes to Lifeline program

  6. Whathappened to the Lifeline Program? • Lifeline Reform Order adopted Jan. 2012, designed to save $200 million by requiring all carriers to recertify the eligibility of subscribers; • Required carriers to enforce the “One phone per home” rule; • Required carriers to cease service to any Lifeline subscriber who did not recertify eligibility, including those that could not be reached by carriers.

Whathappened to the Lifeline Program? • In 1/31/13 Public Notice, FCC now estimates that it will save $213 million in 2013, and that 20% of Lifeline subscribers will be dropped; • All carriers had to file FCC Form 555 by 1/31/12 which provides data as to the number of subscribers contacted, and the number decertified. • http://apps.fcc.gov/ecfs/comment_search/input?z=l42l2 and type in Docket 11-42, search for your carrier.
