RELEVANCE OF THE OP-ICESCR • Provides an opportunity for compensation in individual cases when a State violates economic, social and cultural rights (ESCR) • Provides the possibility to seek justice at the international level when access to justice at the national level has been denied • Provides the CESCR with an opportunity to advance new jurisprudence and to further define the content of ESCR and State’s obligations • Provides the possibility of a more timely response from international mechanisms of protection • Provides the possibility of achieving structural reform and protection for the most vulnerable groups in society
