  3. Recent Trends and Industry Characteristic of Antidumping Measures • Some observations & perceptions on the utilization of trade remedy instruments since the financial crisis; • China’s conception and reaction to the current change.

Some Observations & Perceptions • The international financial crisis has significantly & negatively impacted the world economy and no sign of ending is seen so far. • Governments of many countries and economic entities announced stimulus plans to save the economy from dropping further into recession. • Calling for protection of domestic industries rises, possibly leading to the rise of trade protectionism. • Impact of frequent use of trade remedies in economic downturn.

  5. Some Observations & Perceptions • Growing concern from the international community. • Leaders of G20 declare to oppose to any type of trade protectionism.

  6. Some Observations & Perceptions • Statistics of WTO show a historical trend; • China has been all along the biggest victim for the past 14 years; • Environment for China’s exports worsened since 2008.

  7. Some Observations & Perceptions • In 2008: • 73 AD investigations, accounting for 35% of the total; • 10 CVD investigations, accounting for 71%. • From Jan. to Apr. of 2009, 13 countries (regions) opened 38 AD, CVD, SG and SSG to China’s products, $7.5 billions’ export value affected.

China’s Conception and Reaction to the Current Change • Becoming a major and target export market of foreign products in certain sectors; • Higher demand from a variety of domestic industrial sectors for trade remedy, including chemical/petrochemical, machinery, electrical, steel, light industry, etc. • Using trade remedy instruments in a way of not rendering trade protectionism.

China’s Conception and Reaction to the Current Change • There must be a clear distinction between legitimate trade remedy and trade protectionism. • only those fully WTO-compatible trade remedy investigations or measures are not deemed as trade protectionism. • Due constraint shall be given and cautious attitude taken as to the initiation of trade remedy investigations. • Consultations must be strengthened and industrial collaboration be encouraged as a constructive way of solving the trade issues. • Prevention of abuse of measures is a long-lasting mission to the Government. • Trade remedy is not always a panacea to the rescue of falling domestic industries, but may be considered as the last resort.

China’s Conception and Reaction to the Current Change • Actions taken by China regarding trade remedy: • Strengthening the disciplines of examining the application; • Encouraging the domestic industry and foreign counterparts to open dialogue and seek possible solution before initiation; • More opportunities are provided to interested parties to present views and comments, including inter-governmental consultation and communication; • Full account is taken of where price undertaking is offered • Cooperating mechanism has been established between China and other WTO Members and it works perfect.

  11. China’s Conception and Reaction to the Current Change • AD initiations: • In 2008, 6 antidumping case initiated, only accounting for 7.2% of AD cases initiated against Chinese exports; • From Jan. – now of 2009, 10 exporting Members were involved in AD investigations.

China’s Conception and Reaction to the Current Change In summary: • Relatively fewer AD cases, compared with China’s trade scope and scale; • Cautious attitude to utilize trade instruments; • Calling for strengthening cooperation among WTO Members; • Preventing the overspread of trade protectionism.
