Relevant laws. These 4 laws relate to solid waste: Resource Conservation and Recovery Act (1976) Toxic Substances Control Act (1976) Comprehensive Environmental Response, Compensation, and Liability Act (1980) More commonly known as CERLA or Superfund Nuclear Waste Policy Act (1982).

  1. Relevant laws • These 4 laws relate to solid waste: • Resource Conservation and Recovery Act (1976) • Toxic Substances Control Act (1976) • Comprehensive Environmental Response, Compensation, and Liability Act (1980) • More commonly known as CERLA or Superfund • Nuclear Waste Policy Act (1982)

Resource Conservation and Recovery Act (1976) • Gives the EPA the authority to control hazardous waste from the “cradle-to-grave” • Includes generation, transportation, treatment, storage, and disposal of hazardous waste • Encourages individual states to develop plans to manage MSWs • Set criteria for landfills and prohibited open dumping of MSWs

  4. Toxic Substances ControlAct (1976) • Gave the EPA the authority to track industrial chemicals produced or imported within the United States • Gave the EPA the power to ban the manufacture/importation of chemicals that pose risk

CERCLA (1980) • More commonly known as Superfund • Provided authority for the federal government to respond to releases or possible releases of wastes that could threaten public health or the environment • Established rules for closed and abandoned hazardous waste sites • Established liability for corporations responsible for hazardous waste sites • Created a trust fund for cleanup if responsible companies/parties not identified

  7. Cercla (1980) • In direct response to disasters like those in Love Canal, NY and Valley of the Drums, KY RED= priority YELLOW= alternative site GREEN = deleted/cleaned

  9. Nuclear Waste PolicyAct (1982) • Established federal authority to provide permanent locations for permanent disposal of high-level radioactive wastes • Required operators of nuclear power plants to pay for the costs of this disposal • Think about Yucca Mountain!

Be sure to give plenty of reasoning and examples: • Who is responsible for this tragedy? • What could have been done to prevent it? • What types of solid wastes were dumped here? • Which law would have prevented this from happening? • Which method of disposal (from yesterday’s notes) would you recommend and why?
