Section 1113 of NCLB, Title I Eligible School Attendance Areas (Does not apply to LEAs with fewer than 1,000 children)
Eligible School Attendance Areas • Are based on poverty measures (district-wide percentage or higher) • Ranked annually by percentage of poverty • Served first if more than 75% poverty • Served in rank order • May be grouped by grade at 75% and below
Attendance Area Defined by NCLB, Section 1113 (2) (A)the term ‘school attendance area’ means, in relation to a particular school, the geographical area in which the children who are normally served by that school reside; and
Attendance Area Defined by NCLB, Section 1113 (2), Cont. • (B) the term ‘eligible school attendance area’ means a school attendance area in which the percentage of children from low income families is at least as high as the percentage of children from the low-income families served by the local educational agency as a whole.
Must use same eligibility measures to: • Identify eligible areas • Rank attendance areas • Determine allocations • (Measure may be a composite of indicators)
LEA Discretion • May designate any area/school with at least 35% poverty • May choose not to serve areas or schools with higher percentage of low-income children if: • school meets comparability requirements
LEA Discretion (continued) • school receives supplemental funds from state or local sources spent according to Title I requirements, or • funds expended from other sources equal or exceed amount provided by Title I
LEA Discretion (continued) • Funds may be used for a school in an ineligible attendance area if the percentage of enrolled children from low-income families is equal to or greater than the percentage in a participating attendance area.
SPECIAL RULE • Private school student participation shall be determined without regard to whether the public school attendance area is assisted under Part A.
Allocations • LEAs will allocate funds to eligible areas or schools, in order of ranking, on the basis of total number of children from low-income families in each area or school. • LEAs may allocate higher per pupil amounts to schools with higher percentages of poverty, e.g. 90 to 100%, $500 per pupil; 80 to 90%, $450 per pupil, etc.
125% Rule • The 125% rule does not apply to an LEA that serves only schools in which the percentage of low-income children is 35% or greater. • If the 125% rule is used, school/area allocations shall be at least 125% of the per pupil amount the LEA received for that year.
125% Rule (Continued) • If 2,000 children in an LEA meet low-income eligibility criteria, and $1 million is allocated to the LEA, $500 is the per pupil amount. • Allocations to schools/areas of 125% of $500 per eligible pupil would be $625 per eligible child.
Reservation--An LEA shall reserve funds to serve: • Eligible homeless children who do not attend participating schools, including provision of educationally related support services to children in shelters • Children in institutions for the neglected or delinquent • Neglected or delinquent children in community day school programs
