Kurtzman– what First Amendment clause is this based on? • What was the Supreme Courts decision? • a.) Engel v. Vitale – 1.) struck down state sponsored prayer in school. 2.) Court said that the prayer demonstrated the state officially backed religion. • b.) Lemon v. Kurtzman– 1.) Struck down state funding for private religious schools – struck down state funding paying parochial school teachers for teaching secular subjects. 2.) Three pronged lemon test.
C.) Oregon v. Smith/Reynolds v. United States – Free Exercise Clause • D.) Reynolds v. United States – the decision restricted polygamy in the United States. • They would not accept unconstitutional – why? • It’s not a government action – a government action can be unconstitutional – this is a personal decision. • Oregon v.
