  2. Objectives • 1. The participant will transmit Plans of Correction (POC) that are acceptable and include regulatory elements which will avoid delays in the enforcement cycle and may avoid or reduce CMP’s. • 2. The participant will be aware of new legislation related to Informal Dispute Resolution Process.

  4. Good News • Optional Plan of Correction Tool Forms are available at www.ok.gov/health. On the Left side click on Protective Health, then click on right side Long Term Care, then back to left side menu for Long Term Care Forms.

How Do Timely Acceptable POC’s Help? • 4 Levels of Deficiencies Level A Deficiencies: No more than minimal Harm Level B Deficiencies: No Actual Harm Has Occurred, but the Potential for More than Minimal Harm exists Level C Deficiencies: Actual Harm Has Occurred in an Isolated instance or a pattern Level D Deficiencies: Serious and Immediate Concern (SIC)

More Good News • Timely Acceptable POC’s can avoid or diminish the duration of per day penalties. • Opportunity to Correct (OTC) – Level A and Level B deficiencies • No Opportunity to Correct (NOTC) – Level B (Continuing Non-Compliance (CNC)if not corrected upon revisit), Level C, and Level D

  11. More Good News Continued • Acceptable POC’s increase the likelihood of achieving compliance sooner (decreasing per day penalties). • Correction dates can be earlier than alleged completion dates on the plan of correction.

  12. OAC 310:663-25-4 • (6) If the violation has been corrected prior to submission and approval of a plan of correction, the continuum of care facility or assisted living center may submit a report of correction in place of a plan of correction. The report of correction shall address those requirements specified in this section.

Upcoming Informal Dispute Resolution Process for Assisted Living Centers • SB 592 • Informal Dispute Resolution (IDR) • Effective November 1, 2013 • Scheduled for the second Monday of every month • IDR Request form is on OSDH Website, follow link on left side of page “Protective Health,” then on right side “Long Term Care,” then left menu item, “Long Term Care Forms.” Select the assisted living form 833AL. • In the process of amending letters to provide notice of your right to IDR. • Stay Tuned…
