Age of Consent By common consent gray hairs are a crown of glory; the only object of respect that can never excite envy. George Bancroft By: Glenn Foh
Why I chose this topic • I am a bound by some of the strict rules of the government in regards to children • I live in Singapore, a very strict country with very strict laws • The stress placed on children and some of the controversies that took place in Singapore especially with 15 year old girls that had romantic relationships with older men.
Age of Consent • What is consent? • Implied Consent • The age of consent in the state of Alabama is 16 Implied consent is consent which is not expressly granted by a person, but rather inferred from a person's actions and the facts and circumstances of a particular situation (or in some cases, by a person's silence or inaction). Consent refers to the provision of approval or agreement, particularly and especially after thoughtful consideration –Merriam-Webster Dictionary The age of consent is the minimum age at which a person is considered to be legally competent to consent to sexual acts
Knowledge Issue To what extent is it justifiable to use age as an indicator of one’s maturity and ability to make rational decisions?
Pedophilia • Is defined as a psychiatric disorder in persons who are 16 years of age or older typically characterized by a primary or exclusive sexual interest in prepubescent children (generally age 13 years or younger, though onset of puberty varies). The prepubescent child must be at least five years younger than the adolescent before the attraction can be diagnosed as pedophilia. • The words "pedophile" and "pedophilia" are sometimes used informally to describe an adult's sexual interest or attraction to pubescent or post-pubescent teenagers and to other situations that do not fit within the clinical definitions. • Even more problematic are situations where the terms are misused to refer to relationships where the younger person is an adult of legal age, but is either perceived socially as being too young in comparison to their older partner, or the older partner occupies a position of authority over them
Statutory Rape • The term "statutory rape" is used in some legal jurisdictions to refer to sexual activities in which one person is below the age required to legally consent to the behavior
Real Life Situation Marshall Freeman, a 44 year old police officer in Alabama resigned after allegations that he had sexual relations with a 16 year old girl
Authority figure • As the police officer was an authority figure, he serves to be an example to society and as an enforcer of decency. This is why some would feel that he should be held to a higher standard as his actions may be seen as an example to a society or may send a message that relationships between significantly younger women or teenagers and older men is ‘ok’ • Some other states have laws that state if an authority figure, such as a police officer, is involved that age of sexual consent rises from 16years to 18 years.
The differences between Child and Youth • In terms of maturity and their ability to make rational decisions? • How does society decide when one stops being a child and starts being a young adult? • How does one define a child?
Are young adults the same as adults? • Adults believe them to be still too inexperienced • What are the views of the adults on the matter? • Are young adults still perceived as no different from children in the eyes of adults?
Knower’s Perspective • As a person that has suffered from not meeting the age of consent • The services and goods which require an age of consent; alcohol, tobacco, access into nightclubs and similar establishments are not considered “beneficial” to my well-being • I have known a few of my peers who are in a similar situation but have decided to go against the law without suffering from any repercussions
Youth Activism • What constitutes as youth activism? • Suffrage • Examples?
Generation Gap • The generational gap is a term popularized in Western countries during the 1960s referring to differences between people of younger generations and their elders, especially between children and their parents. -Howe, N. and Strauss, K. (1992). "The New Generation Gap", The Atlantic Monthly. • Baby Boomer VS The old Generation 50s and 60sGeneration X 60s to 80s- Latchkey kid, Child neglect, • Generation Y 80s to 00s- • Generation Z 00s onwards- Born into technology, iGeneration. • Technological influences • Slang • Language use • Advantage of access to technological tools in the information era
The perspective of adults • It is not ok for their children to be associating themselves with men nearly 20 years their senior • They may believe that their children are not mature enough to have relationships with older men or that they may be taken advantage of • In many media
Lynn Philip’s case study • In 1999, Lynn Philips conducted a well-known study for Planned Parenthood in which she interviewed teenage girls mostly between the ages of 14 to 17 who were involved with men ages 21 to 29 The teenagers didn't believe they were being exploited. The perceived benefits of their relationships were admiration from their peers and their partner's material assets. They believed their partners would be more faithful than boys their own age because older men were finished "sowing their oats." • Older women interviewed about the relationships they had as teens felt quite differently. "They had very little good to say at all when they were older: many were angry, really angry," Philips said. "They were pretty much disgusted." Philips argued that individual needy girls and exploitative men are not the only factors driving these relationships. "From music videos, to porn, to Disney, this is all sits within this bigger cultural context of media images and cultural messages that absolutely eroticize and hyper-sexualize teen girls," she said. "As much as we say we're appalled by [these relationships] and concerned by them, there are things out there in the culture that make this happen."
Adultism • "the power adults have over children” -Flasher, J. (1978). "Adultism". Adolescence13 (51): 517–523. PMID735921. • Adultcentrism - The bias adults have of children leading to them underestimating them. • A form of Ageism
Ways of Knowing • Sense Perception • 16 year old girls are seen as physically mature • Reason • All16 year old are allowed to engage in sexual relations with other 16 year olds • The girl and man in question are both above the age of sixteen • Both the man and the girl are allowed to engage in sexual relations with each other • Emotion • The 16 year old is addressed as a girl which seems to portray her as immature • Language • 16 year old girls have been classified by the law as being ‘above the age of consent’ • The 16 year old is addressed as a girl which seems to portray her as immature
Areas of Knowledge • Ethics (Utilitarian vs Kantian) • History
History • Child Brides • Child Rights • The age of consent has been slowly increasing
Utilitarian vs Kantian • Utilitarian view: Parents will rest easier knowing that their children will be safe as they are simply not mature enough to be able to cope with the rigors of a romantic relationship • Kantian view: Youth, especially those that have reached the age of consent should be free to love and have relationships with older adults
Conclusion Adults are traditionally viewed as care-givers and children as care-takers in a parental sense which has become ingrained into the minds of parents in the world, however the new generation can be seen as being more mature from their early access to technological tools allowing them to make more informed decisions. Yet despite this technology does that mean the we are emotionally mature enough
