Starter – Recap on Magistrates 1 What % of criminal cases do magistrates deal with? 2 Describe the range of sentences they can impose on people found guilty of breaking the law. 3 What 3 qualifications do you need to become a magistrate NOTE:Magistrates generally work in 3’s one full time paid magistrate and 2 unpaid part time magistrates. Another name for a PT magistrate is: Justice of the Peace

Homework – Due Today You are a journalist for a local newspaper and have been asked to write a story on: “How representative magistrates are of the local community.” Obviously you must do your research on your topic. Write your newspaper article and remember to use appropriate paragraphs and a suitable headline. No Homework then please complete in detention Tomorrow at 1.10pm in H104 – alternatively email it to me by this evening please.

What is the point of punishment for offenders? • Punishment – Separates offender from friends family and outside world. • Public protection – to ensure wider public and victims are safe. • Deterrence – To stop them re offending. • Rehabilitation – To help them overcome their problems which caused them to offend in the first place eg education, anger management drug/ alcohol problems... • Disapproval of society - To show them that it is wrong and not acceptable what they did. Shame. Task:1Which of the above are the most important? Explain why. 2 Which is the least important? Explain why.

Looking at some facts: Q- What is the difference between fact & opinion? • The UK has one of the highest prison populations of western Europe – over 85 000 in prisons originally built for much smaller prison numbers which means that there is severe overcrowding. • 60% of criminals who serve short sentences reoffend within a year of leaving prison which costs the country between £7 & £10 billion. • Each prisoner costs the taxpayer approximately £50,000 a year • One study of rehabilitation work by St Giles Trust found that every £1 invested in specialist rehab programmes saved the public purse £10 Q – Do you think the UK is one of the most violent countries in western Europe as prison numbers would show?   9. Resettling offenders Mohammed Ellis-Francis is a Feltham "resettlement broker", working with offenders before and after release. "One of the things that I find with young offenders is that there can be a lot of hope and aspirations - they can be very positive. But there are many background issues that need dealing with. I'm talking things like homelessness, family problems and drugs. "Gang crime a big issue for a lot of them - but the question is whether we can do more than fix just one problem - and help them fix their entire lives. So we're working to resettle some people who, at the end of the day, have never been settled. "My job is to be a continuous thread, to stop them going from agency to agency, pillar to post on release. I make practical interventions - make sure they get to an interview, get housing to sort out their accommodation." LO: To understand the main reasons why we punish offenders.   10. What Different Types of Punishments can be handed out to offenders? LO: To understand the different types of punishment which face offenders.To think about alternative types of punishment and /or help for offenders. • Prison • Community sentences – • Curfew Orders& Tagging • Exclusion orders • Fines • Discharges Task 1 Copy out the above title and punishments and after each punishment write a sentence or two to explain each. 2 Now explain the advantages and disadvantages of each punishment. 3 Can you think of any alternative types of punishments which could be used? Write them down and explain one in turn. 4 Copy out the information on Appeals below: Appeals – If you do not think you have had a fair trial or think the sentence is too harsh then you may be able to appeal. Everyone has a right to appeal but only if you have a good reason eg too much press coverage or a beyond the norm sentence.
