    2. Preferred Worker Program (PWP) History - 1990 Incentives to Oregon employers for re-employment of Oregon injured workers Purpose Overcome obstacles to employment resulting from an Oregon on-the-job injury

    3. PWP Eligibility Employer: Subject Oregon employer Compliant with workers’ compensation law Active coverage Leasing company – licensed OAR 436-110-0310

    4. PWP Eligibility Worker: The worker has an accepted disabling Oregon compensable injury or occupational disease Medical evidence indicates the worker will not be able to return to the job at injury due to injury-caused permanent restrictions Must be authorized to work in the U.S. Subject Oregon worker OAR 436-110-0310

    5. Preferred Worker (PW) Eligibility Card Automatically issued at claim closure Upon manual determination of eligibility Note: Good for PW’s lifetime OAR 436-110-0320

    6. Premium Exemption (PE) OAR 436-110-0325 No premiums or assessments for three years Must pay cents per hour – WBF assessments Employer must notify Insurer within 90 days from the worker’s date of hire or eligibility Claim Cost Reimbursement - effective for three years while employed under PE OAR 436-110-0330

    7. Wage Subsidy (WS) General Provisions Effective date is mutually agreed to by division, employer, and worker if applicable 183 calendar days 365 days – exceptional disability 50% of gross wages 75% - exceptional disability Interruption – once for reasonable cause, minimum 10 days OAR 436-110-0335

WS General Provisions (Continued) Pay structure is the same for employees doing the same job Submit a WS Reimbursement Request form with a copy of payroll record Reimbursement requests must be made within one year of the agreement end date WS can not be used for “regular employment” unless job has been modified OAR 436-110-0335

    9. WS – Worker Activated WS form must be completed and signed by the worker and employer Requested within three years of the hire date May use twice Same employer, two different jobs Two employers Cannot use for the same job as the Employer at Injury activation OAR 436-110-0337

    12. Employment Purchases (EP) - General Provisions

    13. EP Categories Employment Purchases are limited to: Clothing - $400 Tools & equipment - $2,500 Tuition, books & fees - $1,000 $500 for travel expenses Occupational Certification - $500 Union dues- initiation fees or back dues & one month’s current dues OAR 436-110-0345

    16. EP Categories (Continued) Moving expenses - one time per eligibility Household goods up to 10,000 lbs. Mileage for one vehicle (one way) Rental allowance- 1st month’s rent & non-refundable deposit (not >month’s rent); credit check Temporary lodging & food for Preferred Worker OAR 436-110-0345(2)(e)(A)(B)

    19. EP Categories (Continued) Placement Assistance Must be provided by a certified vocational counselor or any public or private employment agency. Must result in at least 90 days of employment. Limited to $2000 Cannot be combined with vocational assistance under OAR 436-120 OAR 436-110-0345(2)(i)

    21. EP Categories (Continued) Miscellaneous - $2,500 max. per eligibility Purchases that don’t fit in any other EP category Purchases necessary to help find, accept, or retain employment Does not include vehicles OAR 436-110-0345 (2)(j)

    23. EP Categories (Continued) Worksite Creation - $5,000 Equipment, furnishings and other items needed by the employer to create a new job All items purchased belong to the employer OAR 436-110-0345 (2)(h)

    26. Worksite Modification (WM)- General Provisions WM means altering a worksite in Oregon to enable a worker to work within the injury-caused permanent limitations WM limited to $2,500 for on-job-training under OAR 436-120 or similar OJT programs WM not limited with Employer at Injury OJT Maximum $25,000 for one job per qualifying claim >$25,000 available for exceptional disability OAR 436-110-0350

    27. WM- worker activated Two uses- once with two different employers or for two different jobs with same employer Request must be received within 3 years from date of hire Maximum $25,000 >$25,000 for exceptionally disabled OAR 436-110-0352

Requesting WM Benefit Can be made by worker, employer or third party via phone, email or letter PWP Consultant assigned request Consultant documents injury-caused permanent limitations Consultant provides onsite meeting & evaluation with worker/employer. Recommends WM solutions Prepares Worksite Modification Agreement
