10. “Societal culture” (maatschappelijkecultuur) The sort of culture that I will focus on … is a societal culture — that is, a culture which provides its members with meaningful ways of life across the full range of human activities, including social, educational, religious, recreational, and economic life, encompassing both public and private spheres. These cultures tend to be territorially concentrated, and based on a shared language. I have called these ‘societal cultures’ to emphasize that they involve not just shared memories or values, but also common institutions and practices. Kymlicka, MC, 76

14. Keuzen vs omstandigheden Als we burgers serieus nemen als vrije subjecten, dan veronderstelt dit een anticipatie op individuele verantwoordelijkheid. Hieruit volgt dat maatschappelijke ongelijkheid die voortkomt uit individuele keuzen in principe geen aanleiding kan zijn voor compensatie. Maar maatschappelijke ongelijkheid die voortkomt uit ongekozen omstandigheden (bijv. een handicap), waarvoor men dus niet verantwoordelijk is, constitueert een onrechtvaardige achterstand. Een dergelijke achterstand komt juist weer wel in aanmerking voor compensatie.

15. Verrijking bestaande “societal culture” So while there are many aspects of their heritage that immigrants will maintain and cherish, this will take the form not of re-creating a separate societal culture, but rather of contributing new options and perspectives to the larger anglophone culture, making it richer and more diverse. 16. Interne restricties en externe protecties Interne restricties zijn claims van een sociale groep die de fundamentele burgerlijke en politieke vrijheden van haar eigen leden schenden. Externe protecties zijn claims van een minderheid op bescherming van eigenheid in relatie tot beslissingen van de ruimere samenleving, bijvoorbeeld op politiek of economisch niveau. Omdat interne restricties een schending zijn van persoonlijke autonomie, verwerpt Kymlicka deze. Externe protecties daarentegen beschermen juist de culturele voorwaarden voor autonomie. Daarom verdedigt hij dit type groepsrechten

17. Integratie Integration is a two-way process — it requires the mainstream to adapt itself to immigrants, just as immigrants must adapt to the mainstream. Enabling integration requires, in the first place, strong efforts at fighting prejudice and discrimination ... Moreover, enabling integration may require some modification of the institutions of the dominant culture in the form of group-specific polyethnic rights, such as the right of Jews and Muslims to exemptions from Sunday closing legislation, or the right of Sikhs to exemptions from motorcycle helmet laws (Kymlicka, MC p. 96).

18. Vluchtelingen en het recht op eigen cultuur Since they have not relinquished (opgegeven) the rights which go with membership in their original culture, refugees arguably should, in principle, be able to re-create their societal culture in some other country, if they so desire (Kymlicka, MC, p. 98).

If a middle-class American chooses to emigrate to Sweden, that is clearly voluntarily, and very few of us would think that she had a claim of justice that the Swedish government provide her with free English-language services (or vice versa for a middle-class Swede emigrating to the United States). But if a peasant from Ethiopia emigrates to the United States, the decision is voluntarily in a very limited sense, even if she was not subject to persecution in her homeland, since it may have been the only way to ensure a minimally decent life for herself or her children (Kymlicka, MC, 99).

Discussievragen • Hoe kun je vanuit dit model aankijken tegen het toestaan van de dubbele nationaliteit? • Idem. maar dan m.b.t. de vraag of een school een gebedsruimte moet bieden. • Is multiculturalisme een bedreiging voor sociale cohesie? • Kymlicka stelt dat cultuur voor het liberalisme alleen een instrumentele betekenis kan hebben. Doet dat recht aan de betekenis die cultuur heeft voor de groepen in kwestie? • Is de toepassing van het keuze-omstandigheden onderscheid hier terecht?
