Election of 1800 Election is decided by the House of Representatives. Ten state delegations voted for Jefferson, 4 supported Burr, and 2 made no choice. 12th Amendment created to make sure this didn’t happen again – Pres. and VP. on separate ballots
“Midnight Appointments” • Adams appointed several Federalists to judgeships hours before he was out of office (including William Marbury). • Jefferson took office, told James Madison to quit working on the appointments • Marbury sued Madison, argued Judiciary Act of 1789
