Overview of Regulations 648/05 & 1875/06 The Community Customs Code and the relevant Implementing Provisions provide for measures that: • Requires trade to provide Customs authorities with information on goods prior to arrival and exit from the European Union (Implemented: 1 JAN 2011) • Customs must carry out safety & security assessments at the EU 1st point of entry for (import, transshipment & FROB containers), as well as at the offices of export and exit for exports • Creates uniform community risk-selection criteria for Security and Safety Risk Analysis based controls (Adopted: APR 2009) • Recognizes the AEO concept, providing reliable traders with trade facilitation measures (Implemented: 1 JAN 2008) • Utilizes the Community Customs Risk Management Framework (CRMF)
How does the Megaports Initiative Fit In? • How do Customs agencies currently use RPMs & NII (X-ray) equipment in conjunction with these new requirements? • What are the impacts on inspection time, costs, etc.? • Other Concerns/Questions
Information Sharing to Enhance Risk Analysis – Internal EU • What information would assist ports without RPMs for risk-profiling? Megaports CAS stored details: • Container Number • Alarm profile & daily files • Max Gamma • Max Neutron • Alarm disposition and comments for NORM/real alarms • Secondary inspection results/files Outside of Megaports: • Vessel Routing/Origin/Destination • Commodity Codes • Shipment Details • What data is relevant to the 1st point of entry to determine where controls should take place? • Would receiving confirmation/details that a container has undergone a radiation scan at another port impact Customs’ risk-profiling?
Information Sharing to Enhance Customs’ Ability to Process Alarms – Internal EU Details/Observations • NORM commodities/profiles • Seizure details • Equipment issues • Lessons-learned • Health & safety issues Activities • Lessons-learned/operator joint training at JRC facilities • Create a “super user” community among experienced Megaports operators • Exercise national response plan for a nuclear security incident • Is EC technical reach-back desired/available to the user community? • What information would help your Customs Agents with their role in the Megaports Initiative?
How can Partner Countries Share Megaports Information – Internal EU 1 CMRS-RIF • Potentially create a closed user group • Formatting changes may be required • Information widely available • Information directly extracted to national risk analysis system, to screen data from ENS • Latest movements of containers • Historical itineraries of containers • Container origin finder • Transhipments patterns and identification of irregular movements • Reporting any new movement of containers under surveillance • Any other options? 2 Contraffic
