New legislation in effect as ofJuly 2012 School districts are required to report every instance of disciplinary action in three areas: • Inappropriate relationship with a student • Falsifying information • Converting public property to personal use
Who may file a complaint? • Parent of child involved in situation • Executive Director of BoEE • Administrator • Fellow teacher • School Board Member
TYPES OF SANCTIONS Letter of Reprimand (LOR): Permanently on file, educator continues to practice Suspension: Prohibited from practicing for a defined period of time, usually with requirements for additional training Revocation: Permanent loss of license with no opportunity for reapplying
Professional Practices • What the board must consider when reviewing criminal history? • Nature and seriousness of the crime • Time elapsed • Degree of rehabilitation • Likelihood of reoccurrence • Number of abuses
Standard I. Physical abuse, sexual abuse, any other child abuse, conviction of crime
Violations of Standard I • Criminal convictions • Sexual involvement with students • Sexual exploitation of students • Child/Student abuse
Standard II. Being on school premises or school sponsored activity involving students while under the influence
Violations of Standard II • Use on school ground • Extra-curricular • Summer/field trips
Standard III. Falsifying or deliberately misrepresenting or omitting material information regarding practitioner’s credentials or the evaluation of students
Violations of Standard III • Falsifying application • Falsifying transcripts • Falsifying license • Falsifying on-line renewal • Altering test score/questions etc. • Signing IEP’s
Standard IV Failing to use time or funds granted for the purpose for which they were intended (ie. Personal internet use)
Violations of Standard IV • District computer • E-mail • Blogging/surfing/Facebook • Purchases • District supplies/materials • Monies • Clubs/clinics/lessons
Standard V Violations of contractual obligation
Violations of Standard V • Breaking contract • Holding two contracts • Teaching outside of licensed content or expired license
Standard VI Failing to make reasonable effort to protect the health and safety of the student or creating conditions harmful
Violations of Standard VI • Discrimination • Bullying/Cyber-bullying (Big parental complaint area)
