  2. Albert Fish • Molested over 100 children • Murdered at least 4 of them • Murdered several adults where he cut them into pieces and admits to eating their ears and nose

  3. Is this a crime? • A woman was shopping in the local grocery store with her four-year-old daughter. When the mother wasn’t looking, the child put $10 worth of candy in the mother’s purse. When they left the store, the mother was arrested for shoplifting • Did she commit a crime? • Did the daughter commit a crime?

  4. Elements of a crime… • A duty to do (or not to do) a certain thing • An act or omission in violation of that duty • Criminal intent

  5. Elements of a crime… 1. A duty to do (or not to do) a certain thing: • The duty is usually described by state statutes that prohibit certain conduct • To establish the duty in a trial, the prosecutor would simply cite a statute to the judge

  6. Elements of a crime… 2. An act or omission in violation of that duty : • The breach of the duty is the criminal act (the specific conduct that violates the statute 3. Criminal Intent: • General means that the defendant • Intended to commit the act • Intended to do evil • Basketball player example

  7. 2 Types of Crimes 1. Felony • A very serious crime punishable either by confinement for more than one year in a state prison or by execution. 2. Misdemeanor • A less serious crime • Usually is punishable by: • Confinement in a county or city jail for less than a year • Fine • Both confinement and fine • Infractions: lesser demeanors that can only be fined • Not entitled to a jury trial (because they can only be fined)

  8. Classifications: • Please look at page 88 in your book • In your notes, please list the 7 classifications for crimes, giving at least 2 examples for each
