TOWN HALL DEBATE RESOLVED: The Oregon Constitution should be amended to limit non-economic damages recoverable for patient injuries caused by healthcare provider’s negligence or recklessness.
Town Hall DebateRules of Civility and Decorum • A coin toss will decide which side begins • The sides will alternate: 1 speaker at a time • Any participants displaying bad behavior will be excluded from the debate • Every debater on your side must speak before anyone in your group speaks a second time In addition • Each debater must speak at leastonce • Debate Notes: You need to write at least 5 arguments/notes for each side
Key Terms for the Debate Economic Damages Awarded to compensate plaintiffs for actual economic losses and costs that will be incurred (lost wages, medical treatment, etc.). Punitive Damages Awarded to punish defendants for particularly egregious conduct. Under existing law, punitive damages cannot be awarded against most individual health providers. Non-economic Damages Awarded to compensate plaintiffs for any injury that does not have a financial value (pain, emotional distress, interference with normal and usual activities, loss of companionship, etc.).
