  2. Multiple Waivers Best Practices • Communicate with NCAA academic and membership affairs (AMA) staff members regarding submission of multiple waivers. • Use instructions for multiple waiver filings on AMA Online.

NCAA Division I Legislative Council Subcommittee for Legislative Relief (SLR) Waiver • What NCAA bylaws are involved in this waiver request? • Bylaw 14.5.5.1 – General transfer rule. • Bylaw 14.5.5.2 – Unfulfilled academic year in residence due to not meeting 2-4 transfer requirements. • Bylaw 14.5.5.4 - Eligibility for institutional athletically related financial aid.

SLR Waiver – Staff Analysis • When did Big Time University begin recruiting Joe? • September 2009. • How many hours did Joe attempt and earn at the two-year institution? • Joe attempted and earned 60 credits. • Why did only 45 of the 60 transfer to Big Time University? • Joe earned 12 hours of “D” credit that were not transferable to Big Time University; it only accepts courses in which a student-athlete (SA) earned a grade of “C” or better. • 3 hours were elective courses that were not transferable. • Unfulfilled academic year in residence due to 2-4 transfer requirements:

SLR Waiver – Staff Analysis (continued) • Any mitigation to explain Joe’s academic record at the two-year institution? • No. • What did Big Time University inform Joe during the recruiting process? • Informed Joe that he only needed to get associate degree. • When did Big Time University conduct Joe’s transfer certification? • During official visit in September 2009; did not get final transcript until December 2010.

SLR Waiver – Staff Analysis (continued) General transfer rule due to financial hardship: • What is cost of attendance (COA) and financial aid packages at both institutions? • Big Time University’s COA is $25,000. Joe received a $20,000 athletics scholarship. • State University’s COA is $20,000 and State would like to provide Joe with athletics aid. • Did Joe try to secure additional financial aid at Big Time University? Why or why not? • Yes, Joe did not qualify for additional scholarship but did qualify for $10,000 in outside loans.

SLR Waiver – Staff Analysis (continued) • What was Joe’s family contribution at both institutions? • Parents provided Joe with $5,000 at Big Time University but will be unable to provide Joe any additional money at State University. • Does Big Time University support waiver request and acknowledge its errors? • Yes.

SLR Waiver Guidelines Assertions of misinformation: • SA relied in good faith on academic misinformation; • When misinformation provided by previous four-year institution led to SA being ineligible; • Applicant institution can document that SA would have been eligible had he/she attended applicant institution directly; and • Possible 10-day case depending on documentation.

SLR Waiver Guidelines (continued) Assertions of financial hardship: • Financial hardship is a result of a specific incident and has a direct link to warrant relief from the legislation (i.e., chronology). • COA at previous institution and applicant institution and what actions SA took to remain at previous institution.

PTD Waiver – Staff Analysis (continued) • Does the mitigation support the deficiency? • Does the documentation support the mitigation? • Have verification of father losing job (letter of termination, unemployment documentation). • Have verification that Joe has been working all summer (statement from employer, pay stubs, etc.). • What has changed for Joe? • Does father have job? • Is Joe on athletics aid? • Has Joe discussed other options for financing education?

  20. PTD Waiver – Decision • Approve. • Rationale. • Personal hardship. But for the family’s financial issues, it seems reasonable to believe Joe would have attempted and passed at least 4 credits during summer school in order to meet the requirement.
