The Crimes Rape (Article 120) • Penile-vaginal intercourse with force and without consent • Even slight penetration is sufficient to complete the offense • Maximum punishment: dishonorable discharge, forfeiture of all pay and allowances, confinement for 5 years to life, death Forcible Sodomy (Article 125) • “Oral sex” or anal intercourse committed by force and without consent • Even slight penetration is sufficient to complete the offense
The Crimes II Indecent Assault (Article 134) • Assault with intent to gratify the lust or sexual desires of the accused Indecent Exposure (Article 134) • Willfully and wrongfully exposing a part of the body to public view in an indecent manner
Who to contact • If sexual harassment is suspected • Contact supervisor • If sexual assault is suspected, contact help A.S.A.P. • The health and well-being of the individual is our first priority • Dial 911 (ask for SF and/or OSI) • Go to ER if a medical emergency • Things that could hinder investigation • Showering • Changing/laundering clothes • Using the restroom
Victim Assistance: Emergency Room • Patient treated as “Urgent” • ER Physician evaluation: Does patient require immediate medical care? • Yes; stabilize patient, then contact OSI and on-call gynecology • No; call OSI and gynecology. • Patient’s care is first priority in ER • ER will insure both medical AND legal needs met
Victim Assistance: Medics & OSI • Gynecology • Trained women’s health specialists (doctor or nurse practitioner) • Usually able to respond to Emergency Department within 1 hour • Gyn exams are thorough and legally sufficient • Office of Special Investigation • Conducts investigation • Determines jurisdiction and if notification of civilian authorities is required. • Assists gynecology staff during the exam
Victim Witness Assistance Program (VWAP) • Program created for the protection and assistance of crime victims and witnesses • Enforces rights of crime victims • Protect victim from further harm • Details agencies which offer assistance and counseling • Notified of court proceedings and process • Ability to confer with the case prosecutor • Informed about conviction, imprisonment and release of the offender • Contact base legal office for further information • Point of contact: SSgt Niles 458-1148
