Department of Traditional Affairs FRAMEWORK FOR THE PROVISION OF ENABLING RESOURCES FOR A MEMBER OF THE NATIONAL HOUSE OF TRADITIONAL LEADERS, A MEMBER OF ANY PROVINCIAL HOUSE OF TRADITIONAL LEADERS AND TRADITIONAL LEADERS PRESENTATION TO THE PORT FOLIO COMMITTEE Dr. MASENJANA SIBANDZE 10 SEPTEMBER 2013
1. PURPOSE To inform the Port Folio Committee of progress made by the Department of Traditional Affairs (DTA) regarding the development of a Framework towards standardisation of enabling resources (Tools of Trade) for traditional leaders to carry out their functions and responsibilities effectively and efficiently.
2. BACKGROUND 1.The presentation deals with the provision of resources that are necessary to enable members of the National and provincial houses of traditional leaders, and traditional leaders to perform their effectively and efficiently. These resources are commonly referred to as tools of trade. 2. It is intended to provide norms and standards in ensuring good governance and to achieve uniformity and therefore eliminate confusion and inconsistencies.
BACKGROUND (CONT) 3. The Independent Commission for the Remuneration of Public Office Bearers is obliged to make annual recommendations relating to the salaries, allowances and benefits, as well as resources required by public office bearers. 4. In the case of resources it is not required that a determination by the President be made. 5. The Commission has by way of Government Notice (Nr 693 of 29 August 2011) made recommendations about the nature of appropriate tools of trade for a member of a National House of Traditional Leaders, a member of any Provincial House of Traditional leaders and a traditional leader.
BACKGROUND (CONT) 6. The DTA in consultation with responsible provincial departments and National and Provincial Houses of Traditional Leaders drafted this framework determining the exact limit of the actual tools of trade to be provided to a member of the National and provincial houses and traditional leaders utilizing the Commission’s recommendations. 7. These resources (Tools of Trade) are: • Accommodation and furniture; • Security; • Special needs facilities; • Basic office infrastructure; • Reading Material; • Study Assistance; • Support Staff; • Official travelling facilities; and • Reimbursement for expenses.
BACKGROUND (CONT) 8. The DTA in consultation with HODs prepared this framework for enabling resources for qualifying traditional leaders and members of houses of traditional leaders utilising the Commission’s recommendations. 9.This framework was presented to MINMEC on 16 August 2013. It was resolved that the framework be re-looked with a view to decrease the financial implications on the state, taking into account affordability, sustainability of the institution and provincial peculiarities.
BACKGROUND (CONT) 10. A revised framework was presented to technical MINMEC on 2 September 2013. 11. The meeting resolved that the Minister obtain written comment on the amended framework from the MECs responsible for traditional leadership. 12. Once comments have been received and the draft framework has been revised where necessary, it is intended to refer it to the MINMEC arranged to take place on 26 September 2013 for consideration and adoption.
BACKGROUND (CONT) 13. Once the framework has been adopted, each provincial department, national house and provincial houses of traditional leaders must, taking into account the framework, develop manuals setting out the exact resources (tools of trade) appropriate for qualifying traditional leaders and members of houses of traditional leaders.
3. RESPONSIBILTIES AND FUNCTIONS OF TRADITIONAL LEADERS • These resources are intended to enable traditional leaders to carry out inter alia, the following responsibilities and functions as provided for in applicable legislation: • Assist Government in identifying the needs of communities; • Recommending relevant interventions on development and service delivery; • Facilitate the involvement of traditional communities in the development and or amendment of IDPs; • Cooperate with ward committees and form partnerships with municipalities; and • Promote the ideals of cooperative governance; and • Promote indigenous knowledge systems for sustainable development.

5. RESOURCE - Accommodation 1.Accommodation means state owned residences occupied by king/queen, principal traditional leader, chairperson and deputy chairperson of the National House and Provincial Houses of Traditional Leaders, for official purposes. 2.Table below indicates the exact accommodation limit allowed for each resource recipient.

RESOURCE - Furniture 1.Furniture refers to movable articles in state owned residences of kings/queens, principal traditional leaders, chairpersons and deputy chairpersons of the National House and Provincial Houses of Traditional Leaders, that make it fit for living or working. 2.The furnishing of state owned residence is limited to the provision, and maintenance, of ordinary household furniture, mattresses, pillows, carpets, curtains, beds, stoves, refrigerators, freezers, washing machines, tumble dryers and heaters, micro-wave ovens and dishwasher
Furniture 3. A maximum value to be determined by the Minister of Cooperative Governance and Traditional Affairs in consultation with the Minister of Public Works and relevant MECs. 4. The Department of Public Works does not provide any furniture or other furnishings in cases where resource recipient use privately owned houses as official residences. 5. Table below indicates the exact limit allowed for furniture for each resource recipient.
5. RESOURCE - Security 2.1 A security analysis for kings/queens, principal traditional leaders, chairpersons and deputy chairpersons of the National House and Provincial Houses of Traditional Leaders must be conducted by the Minister of Safety and Security at the request of the Minister for Traditional Affairs in consultation with the relevant Premiers. 2.2 Following the security analysis, appropriate security arrangements must be made by the relevant authorities. The table below refers to the exact security arrangements permitted.
6. DECISION REQUIRED • For the Portfolio Committee to: • Take note of the presentation; • Make input; and • Endorse the presentation and support the development of the Framework towards standardisation of resources (Tools of Trade) for traditional leaders.
