A PREAMBLE TO THE CONCESSION • 1992: first thoughts on implementation of EU legislation on liberalisation of rail • 1995: separation between ‘trains’ and ‘tracks’ within constraints of NS • 2000: transfer of shares of “ProRail” from NS to Dutch government • 2001: approval of railway act and regulation in Dutch parliament • 2003: “merger” of traffic control, capacity management and infrastructure management into ProRail • 2005: management concession for Dutch main rail infrastructure • 2006: start of the evaluation of the Dutch railway act

CONCESSION RETURNS RESPONSIBILITY TO THE RAILWAY SECTOR • Obligation to take care of transport (NS) and manage the rail infrastructure (ProRail) • Obligation to draw up annual business plans including long range financial plans and professionalisation plans. • Obligation to inform and consult (transparency) • Business plans to improve performance, professionalisation of organisations, and migration to output and outcome steering. • Infrastructure manager is responsible for performance of rail infrastructure in the short and long term. • Railway undertakings are charged minimally the variable costs of infrastructure management

CONCESSION REQUIRES ANNUAL BUSINESS PLAN • Business plan should include: • A description of the way ProRail will effectuate its care obligations • A detailed description of activities during the upcoming concession period including financing • An overview of performance indicators and targets • A vision on ProRail organisation and railway sector including a roadmap to professionalisation of ProRail • An overview of financial requirements for a period of 10 years. • The business plan replaces traditional subsidies and contracts
CONSULTATION OF RAILWAY UNDERTAKINGS IS ESSENTIAL ELEMENT IN BUSINESS PLAN • According to the concession ProRail has to consult railway undertakings and regional authorities on all items which require approval of the Minister of Transport: • Key performance indicators, measurement system, targets and activities • Actions with regard to safety and environment, and accessibility • Agreement with NS on actions with regard to punctuality.
PRORAIL STILL LARGLY DEPENDS ON GOVERNMENT CONTRIBUTIONS • ProRail’s main financial source is the maintenance budget based on the concession. • Access charges are increasingly part of ProRail’s financial means. Currently the access charges are 13% of total costs. • In addition ProRail receives income from separate assignments of the Ministry of Transport and of third parties (regional or local authorities). • Ministry of Transport aims at alignment of all concession related financial requests. As of 2006 investments will also become part of the business plan.

RELATION PRORAIL AND DUTCH GOVERNMENT IS A COMPLEX MIXTURE OF DIFFERENT ROLES • Department of Transportation is 100% shareholder of ProRail • Department of Transportation has granted ProRail a 10-year concession for the Dutch main rail infrastructure • Department of Transportation controls safety supervisor • Regional authorities are increasingly grant transportation concessions and in the near future possibly also maintenance concession • Different sections within the Department of Transportation sometimes have conflicting interest
