Overview • The Division of Waste Management is requesting approval from the EMC to proceed to public comment and hearing for amendments to 15A NCAC 13B Section .1200 Medical Waste Management. • Rules .1201 - .1207 collectively establish standards for the packaging, transportation, storage, treatment, and disposal of medical waste. • These rules are proposed for readoption pursuant to G.S. 150B-21.3A. • The Rules Review Commission established a deadline of April 30, 2021 for the readoption of rules in 15A NCAC 13B Solid Waste Management. • The Regulatory and Fiscal Impact Analysis was approved by OSBM on February 21, 2019. Summary of Rule Changes • The Division is proposing to repeal rules .1205 - .1207 and incorporate the majority of the requirements of those rules into rules .1202 - .1204. • Proposed amendments were drafted with stakeholder input and address technical corrections and updates to information, consolidation of the rules, clarification of vague or unclear language, and removal of redundant or unnecessary language. • The amendments incorporate changes based on a pre-review by Rules Review Commission staff. Previous Comments Received Comment letter received June 2016, included with the Regulatory Impact Analysis in Attachment B. • Requested updates to time limits and refrigeration requirements. • Proposed revisions to requirements in response to the comments are found in Rule .1202(o), (p), and (q) and Rule .1204(a). • Rule .1202(f) and (g) require that medical waste not become putrescent or a nuisance. Summary of Rule Changes • Proposed amendments include clarification for the following: • facility operations plan requirements; • locations where medical waste is temporarily stored or transferred between vehicles during shipping; • alternative treatment method requests; • disposal of noninfectious medical waste, trace chemotherapy waste, and non-hazardous pharmaceutical waste; • packaging requirements to be consistent with CFR and allow some exceptions for customer-loaded trailers; and • ozonation as a treatment method.
