Election boardmission statement It is the purpose of the Muscogee (Creek) Nation Election Board to maintain the highest level of integrity in conducting the Muscogee (Creek) Nation elections according to the Election Codes Title 19, of the Muscogee (Creek) Nation code and enforce the election codes in a responsible, impartial, and unbiased manner. Also to, inform all enrolled registered voters of elections and promote voter registration throughout the Muscogee (Creek) Nation’s eight districts, as well as to the absentee voters outside the Muscogee (Creek) Nation boundaries..

REQUIREMENTS TO FILE FOR PRINCIPAL CHIEF & SECOND CHIEF • MUST BE AT LEAST 30 YEARS OF AGE • MUST BE AT LEAST ONE FOURTH (1/4) OR MORE OF CREEK BY BLOOD • MUST BE A REGISTERED VOTER FOR MCN TRIBAL ELECTIONS FOR AT LEAST 6 MONTHS PRIOR TO FILING FOR OFFICE • PRINCIPAL RESIDENCY MUST BE WITHIN MCN’S JURISDICTIONAL BOUNDARIES FOR AT LEAST ONE (1) FULL CALENDAR YEAR UPON FILING FOR OFFICE • MUST HAVE NO FELONY CONVICTIONS EVER • PAY THE FILING FEE AMOUNT OF: • FOR PRINCIPAL CHIEF- FIFTEEN HUNDRED DOLLARS ($1,500.00) • FOR SECOND CHIEF- ONE THOUSAND DOLLARS ($1,000.00)

  12. PROOF OF RESIDENCY THREE (3) OF THE FOLLOWING DOCUMENTS WILL BE REQUIRED AND ACCEPTED TO ESTABLISH RESIDENCY. ALL THREE (3) DOCUMENTS MUST DISPLAY THE SAME ADDRESS: • PREVIOUS YEAR’S INCOME TAX RETURN • HOMESTEAD EXEMPTION OR COPY OF PROPERTY TAX • FOR RENTERS- A NOTARIZED COPY OF THE RENTAL AGREEMENT FROM THE OWNER OR LANDLORD WITH CONTACT INFORMATION FOR EITHER ONE • UTILITY BILL STATEMENT • DRIVER’S LICENSE OR STATE ID

EMPLOYEES OF MUSCOGEE (CREEK) NATION THAT FILE FOR CANDIDACY UPON THE TIME THEY FILE THEIR CANDIDACY FOR OFFICE, MUSCOGEE (CREEK) NATION EMPLOYEES MUST FILE FOR A LEAVE OF ABSENCE FROM THEIR PLACE OF EMPLOYMENT. EMPLOYEES MUST REPORT BACK TO WORK THE FIRST WORKING DAY AFTER THE ELECTION UNLESS THAT EMPLOYEE IS IN THE GENERAL (RUN-OFF) ELECTION.

  14. CAMPAIGN FINANCING RULES & REGULATIONSINTRODUCTION BEGINNING WITH THE 2019 ELECTION, CAMPAIGN FINANCE RULES & REGULATIONS WILL BE ENFORCED. FOR THE ENTIRE CAMPAIGN FINANCE CODE PLEASE VISIT THE ELECTION BOARD WEBSITE. THE FOLLOWING SLIDES WILL HIGHLIGHT DETAILS ABOUT MUSCOGEE (CREEK) NATION CAMPAIGN FINANCE CODE.

  15. CAMPAIGN FINANCING • UPON FILING FOR OFFICE, CANDIDATES WILL BE REQUIRED TO SUBMIT AN INITIAL CAMPAIGN FINANCE DISCLOSURE STATEMENT FOR THE PERIOD FROM WHEN THE CANDIDATE FIRST PUBLICLY DECLARED THEIR INTENT TO SEEK OFFICE OR BEGAN CAMPAIGN FUNDRAISING, TO WHEN THE CANDIDATE FILED FOR OFFICE. FOR THE 2019 ELECTION, THE INITIAL CAMPAIGN FINANCE DISCLOSURE STATEMENT WILL BE DUE BY JULY 22ND, 2019 AT 5:00PM CST. • CANDIDATES ARE REQUIRED TO UPDATE AND SUBMIT FINANCIAL DISCLOSURE STATEMENTS AT THE END OF EVERY MONTH TO THE ELECTION OFFICE AS LONG AS THEY REMAIN A CANDIDATE IN THE ELECTION. IF FINANCE DISCLOSURE STATEMENTS ARE NOT SUBMITTED WITHIN 5 DAYS OF THE LAST DAY OF THE PREVIOUS MONTH, THE ELECTION BOARD MAY SEND A SHOW CAUSE NOTICE TO THE CANDIDATE FOR LATE REPORTING.

  16. CAMPAIGN FINANCING • IN THE EVENT THAT A CANDIDATE EXCEPTS CAMPAIGN CONTRIBUTIONS THROUGH DONATIONS OR FUNDRAISERS, THE CANDIDATE WILL BE REQUIRED TO DEPOSIT THOSE CONTRIBUTIONS INTO A SEPARATE BANK ACCOUNT EARMARKED FOR CAMPAIGNING PURPOSES. • THERE ARE TWO FORMS OF CAMPAIGN CONTRIBUTIONS: ‘MONETARY’ AND ‘IN-KIND’ • MONETARY CONTRIBUTIONS ARE CASH OR THE EQUIVALENT • IN-KIND CONTRIBUTIONS ARE GOODS OR SERVICES RECEIVED THAT HAVE A MONETARY VALUE

  17. CAMPAIGN FINANCING • CANDIDATES MUST REPORT CONTRIBUTION AMOUNTS THAT EXCEED ONE HUNDRED DOLLARS ($100.00). THIS AMOUNT MAY BE FROM A ONE TIME CONTRIBUTION OR FROM AN ACCUMULATIVE TOTAL. • CANDIDATES MAY NOT ACCEPT CONTRIBUTION AMOUNTS THAT EXCEED FIVE THOUSAND DOLLARS ($5,000.00), FROM EITHER A ONE TIME CONTRIBUTION OR FROM AN ACCUMULATIVE TOTAL. • CANDIDATES ARE NOT REQUIRED TO REPORT PERSONAL FUNDS USED FOR CAMPAIGNING PURPOSES. CANDIDATES WILL STILL BE REQUIRED TO SUBMIT CAMPAIGN FINANCE DISCLOSURE STATEMENTS WHEN USING PERSONAL FUNDS.

  18. CAMPAIGN FINANCING • ALL CAMPAIGN FINANCE DISCLOSURE STATEMENTS WILL REMAIN ON FILE FOR THE PERIOD OF A FOUR (4) YEAR TERM THAT THE CANDIDATE SERVED OR WOULD HAVE SERVED. CAMPAIGN FINANCE DISCLOSURE STATEMENTS WILL BE MADE AVAILABLE TO THE PUBLIC UPON WRITTEN REQUEST. A COPYING FEE OF ONE DOLLAR ($1.00) WILL BE CHARGED FOR THE FIRST PAGE AND FIFTY CENTS (.50) FOR EACH ADDITIONAL PAGE.

  19. Campaign financing • IF A CANDIDATE RECEIVES A SHOW CAUSE NOTICE FROM THE ELECTION BOARD FOR LATE REPORTING, THE CANDIDATE WILL HAVE FIVE (5) WORKING DAYS FROM THE DATE OF RECEIVING THE SHOW CAUSE NOTICE TO FILE A RESPONSE WITH THE ELECTION BOARD. CANDIDATES MAY REQUEST A HEARING BEFORE THE ELECTION BOARD BY FILING A WRITTEN REQUEST FOR HEARING WITHIN FIVE (5) DAYS OF RECEIVING THE SHOW CAUSE NOTICE. IF REQUESTED, A HEARING SHALL BE HELD BEFORE THE ELECTION BOARD TO DETERMINE WHETHER THE CANDIDATE FAILED TO FILE A CAMPAIGN DISCLOSURE STATEMENT WITHIN THE REPORTING DEADLINE.

  20. CAMPAIGN FINANCING • IF IT IS DETERMINED BY A MAJORITY OF THE ELECTION BOARD BY A PREPONDERANCE OF THE EVIDENCE THAT A CANDIDATE FAILED TO FILE A CAMPAIGN DISCLOSURE STATEMENT IN A TIMELY MANNER, THE FOLLOWING PENALTIES MAY BE IMPOSED FOR EACH VIOLATION: • UPON THE FIRST VIOLATION, A FINE MAY BE IMPOSED IN AN AMOUNT UP TO BUT NOT EXCEEDING TWO HUNDRED FIFTY DOLLARS ($250.00). • UPON A SECOND OR SUBSEQUENT VIOLATION, A FINE MAY BE IMPOSED IN AN AMOUNT UP TO BUT NOT EXCEEDING FIVE HUNDRED DOLLARS ($500.00)

  21. CAMPAIGN FINANCING • ANY CANDIDATE WHO FILES A FALSE OR INACCURATE CAMPAIGN FINANCE DISCLOSURE STATEMENT OR IF THE CANDIDATE FAILS TO FULLY DISCLOSE THE SOURCE OR AMOUNT OF ANY CAMPAIGN CONTRIBUTION, SHALL UPON CONVICTION BE GUILTY OF A MISDEMEANOR AND SUBJECT TO A FINE OF NOT MORE THAN ONE THOUSAND DOLLARS ($1,000.00). • ANY CANDIDATE CONVICTED OF FILING A FALSE OR INACCURATE CAMPAIGN FINANCE DISCLOSURE STATEMENT OR FAILING TO DISCLOSE THE SOURCE OR AMOUNT OF ANY CAMPAIGN CONTRIBUTION SHALL NOT BE ELIGIBLE TO RUN FOR ANY ELECTIVE OFFICE WITHIN THE MUSCOGEE (CREEK) NATION FOR A PERIOD OF TEN (10) YEARS AFTER THE DATE OF CONVICTION.

  22. CAMPAIGN FINANCING • NO CANDIDATE SHALL BE SWORN INTO OFFICE AND NO CANDIDATE SHALL HOLD ANY ELECTIVE OFFICE UNLESS ALL CAMPAIGN DISCLOSURE STATEMENTS HAVE BEEN FILED AND ANY ASSESSED FINES HAVE BEEN PAID BY THE CANDIDATE.

  23. CAMPAIGN FINANCING • CONTRIBUTIONS ACCEPTED BY THE CANDIDATE SHALL BE USED TO COVER THE COST OF A CAMPAIGN FOR ELECTIVE OFFICE AND ANY ORDINAR Y AND NECESSARY EXPENSES INCURRED BY THE CANDIDATE DURING THE CANDIDATE’S CAMPAIGN FOR ELECTIVE OFFICE. • ANY CONTRIBUTIONS PLUS ANY INTEREST EARNED ON SUCH CONTRIBUTIONS NOT EXPENDED WITHIN THIRTY (30) DAYS AFTER THE CANDIDATE’S CAMPAIGN HAS ENDED SHALL BE DISPOSED BY: • DELIVER EXCESS CAMPAIGN PROCEEDS TO THE ELECTION BOARD TO DEFRAY COSTS OF FUTURE ELECTIONS • DONATING TO THE COLLEGE OF MUSCOGEE NATION. A WRITTEN RECEIPT OR ACKNOWLEDGMENT OF SUCH DONATION MUST BE FILED WITH THE ELECTION BOARD.

  24. CERTIFIED VOTER LISTING THE ELECTION BOARD WILL PROVIDE ALL CANDIDATES WITH A CERTIFIED LISTING OF CITIZENS WHO ARE REGISTERED TO VOTE IN MUSCOGEE (CREEK) NATION TRIBAL ELECTIONS. PER NCA 15-219, A VOTER HAS THE RIGHT TO WITHHOLD HIS OR HER NAME AND ADDRESS FROM APPEARING ON ANY OFFICIAL VOTER LISTING PROVIDED BY THE ELECTION BOARD. THE ELECTION BOARD WILL ASK CANDIDATES TO PROVIDE A NAME(S) OF AN INDIVIDUAL(S) THAT WILL BE AUTHORIZED BY THE CANDIDATE TO RETRIEVE VOTER LISTINGS OR OTHER ITEMS ON BEHALF OF THE CANDIDATE.

  25. CONTESTS OF CANDIDACY • ONLY CANDIDATES MAY CONTEST ANOTHER CANDIDATE’S CAPACITY TO SEEK OFFICE • CONTESTS MUST BE FILED NO LATER THAN 5:00PM ON FRIDAY, JULY 19, 2019 • AT THE TIME A CONTEST IS FILED, THE CONTESTOR MUST PRESENT A NON-REFUNDABLE FEE OF FIVE HUNDRED DOLLARS ($500.00) IN THE FORM OF A CASHIER’S CHECK, CERTIFIED CHECK, OR MONEY ORDER MADE PAYABLE TO MCN ELECTION BOARD

  26. CONTESTING THE RESULTS OF THE ELECTION • ONLY CANDIDATES MAY CONTEST THE RESULTS OF A PRIMARY OR GENERAL ELECTION • CONTESTS MUST BE SUBMITTED TO THE ELECTION BOARD NO LATER THAN: • FOR PRIMARY ELECTION- FRIDAY, SEPTEMBER 27, 2019 BY 5:00PM • FOR GENERAL ELECTION- FRIDAY, NOVEMBER 8, 2019 BY 5:00PM • UPON FILING A CONTEST, THE CONTESTOR MUST PRESENT A NON-REFUNDABLE FEE OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH DISTRICT AFFECTED IN THE FORM OF A CASHIER’S CHECK, CERTIFIED CHECK, OR MONEY ORDER MADE PAYABLE TO MCN ELECTION BOARD

WATCHER RULES & REGULATIONS • CANDIDATES MUST SUBMIT WATCHER’S NAME TO THE ELECTION BOARD MANAGER NO LATER THAN 5:00PM ON: • FOR PRIMARY ELECTION- FRIDAY, SEPTEMBER 13, 2019 • FOR GENERAL ELECTION- FRIDAY, OCTOBER 25, 2019 • WATCHERS MUST SUBMIT TO AN OATH ADMINISTERED BY THE PRECINCT INSPECTOR • WATCHERS SHALL BE LIMITED TO OBSERVATION ONLY AND MAKE ONLY WRITTEN OBJECTIONS THAT THEY WILL FORWARD TO THE CANDIDATE • WATCHERS WILL BE REQUIRED TO REMAIN STATIONED AT THE PRECINCT SITE FOR THE SAME HOURS AS THE PRECINCT WORKERS • WATCHERS SERVE ON A VOLUNTARY BASIS AND WILL NOT BE COMPENSATED BY THE ELECTION BOARD

  28. TITLE 19 CAMPAIGNING REGULATIONS • DURING ELECTION DAYS DO NOT PLACE CAMPAIGN SIGNS OR CAMPAIGN LITERATURE WITHIN 300 FEET OF THE PRECINCT/POLLING SITE DURING THE ELECTION. • YOU CANNOT BRIBE SOMEONE TO VOTE OR YOU COULD BE FOUND GUILTY OF A FELONY • YOU CANNOT BRIBE A CAMPAIGN OPPONENT TO WITHDRAW THEIR CANDIDACY OR YOU COULD BE FOUND GUILTY OF A FELONY

  29. TITLE 19 CAMPAIGNING REGULATIONS • YOU CANNOT ACCEPT A BRIBE FROM A CAMPAIGN OPPONENT TO WITHDRAW YOUR CANDIDACY OR YOU COULD BE FOUND GUILTY OF A FELONY • DO NOT ATTEMPT TO DISCOURAGE OR PREVENT A CITIZEN FROM REGISTERING TO VOTE OR YOU COULD BE FOUND GUILTY OF A FELONY

  30. ANONYMOUS CAMPAIGN LITERATURE AMENDED NO PERSON OR ORGANIZATION CAN POST, PUBLISH, WRITE, OR DISSEMINATE OR CAUSE TO BE POSTED, PUBLISHED, WRITTEN, OR DISSEMINATED ANY ANNOUNCEMENT, PRESS RELEASE, WEBPAGE, SOCIAL MEDIA WEBSITE, OR ADVERTISEMENT THAT IS DESIGNED TO ENDORSE, SUPPORT, INFLUENCE, INJURE, OR OPPOSE THE NOMINATION OR ELECTION OF A CANDIDATE, OR TO INFLUENCE THE VOTERS WHEN A CONSTITUTIONAL OR STATUTORY AMENDMENT OR ANY OTHER QUESTION THAT MAY APPEAR ON A BALLOT WITHOUT PUBISHING THE NAME AND ADDRESS OF THE PERSON OR AT LEAST 2 OFFICERS OF THE ORGANIZATION THAT IS PRODUCING THE ABOVE LITERATURE IN A CONSPICUOUS PLACE ON SAID LITERATURE.

ANONYMOUS CAMPAIGN LITERATURE AMENDED FOR CANDIDATES THAT USE SOCIAL MEDIA WEBSITES FOR CAMPAIGNING PURPOSES THE CANDIDATE MUST CREATE A SEPARATE ACCOUNT OR PAGE IN THE NAME OF THE CANDIDATE’S CAMPAIGN AND NOT THE CANDIDATE’S INDIVIDUAL NAME. FOR EXAMPLE: ACCEPTABLE- BOB FISH FOR 3RD CHIEF (CAN USE FOR CAMPAIGNING) NOT ACCEPTABLE- BOB FISH (CANNOT USE FOR CAMPAIGNING)

TITLE 37 CHAPTER 6 CAMPAIGNING REGULATIONS • CANNOT USE TRIBAL EQUIPMENT, SUPPLIES, OR PROPERTY FOR YOUR CAMPAIGN OR YOU COULD BE FOUND GUILTY OF A MISDEMEANOR • EMPLOYEES OF MUSCOGEE (CREEK) NATION CANNOT HELP CANDIDATES WITH THEIR CAMPAIGN WHILE THE EMPLOYEE IS BEING COMPENSATED FOR THEIR TIME BY MUSCOGEE (CREEK) NATION OR THE EMPLOYEE COULD BE FOUND GUILTY OF A MISDEMEANOR

New for the 2019 election:early in-person voting • EARLY IN PERSON VOTING WILL TAKE PLACE ON THE WEDNESDAY AND THURSDAY IMMEDIATELY PRECEDING THE DAY OF ELECTION • EARLY IN PERSON VOTING HOURS WILL BE FROM 7:00AM TO 7:00PM • ALL LAWS THAT APPLY ON ELECTION DAY WILL APPLY TO EARLY IN PERSON VOTING DAYS • BALLOTS AND BALLOT BINS WILL BE TRANSPORTED TO LIGHTHORSE HEADQUARTERS AT THE CONCLUSION OF EACH EARLY IN PERSON VOTING DAY FOR OVERNIGHT STORAGE AND SECURITY
