REACHING AGREEMENT THROUGH MEDIATION • Divorce mediation is becoming an increasingly popular alternative to a traditional divorce. The way mediation works is that a trained neutral party facilitates and aids the spouses or domestic partners in coming to their own agreement, which settles the issues in their divorce, including: • Physical custody–child custody, co-parenting and parenting schedules—where will the children live, with whom do they spend holidays • Legal custody—how are major life decisions made? Divorce mediation NYC • The State of New York has adopted “No-Fault Divorce”, whereby New York couples can request a divorce by claiming that there’s been an “irretrievable breakdown” in their marriage or domestic partnership, which means they do not get along anymore, and there is no chance for a reconciliation. • A New York couple may get a no-fault divorce on any of the following grounds: • the marriage/domestic partnership has broken down irretrievably for at least six months. • living apart for a period of one or more years, after a judgment of separation; or • living apart for a period of one or more years pursuant to a separation agreement. • Before a court will grant a no-fault divorce, the couple needs to show and prove that their property division, spousal support, child support, and child custody have all been resolved. This can be done between the spouses in a divorce settlement agreement or by a court order.

DOMESTIC PARTNERSHIP NYC • You and your partner must be residents of New York City. If one or both of you are not residents of New York City, one of you must be employed by the City of New York. • You and your partner must be over 18-years-old. • Neither you nor your partner can be legally married or in another domestic partnership when applying for a certificate. • You and your partner should be in a committed relationship and live together.
