Topics • Update on changes to Saskatchewan’s OH&S legislation: Bill 23 & Bill 85. • How Enform can assist in meeting with the intent of theses legislative changes. Additional information. Refer to document Crossing Borders, Edition 3.0, revised March 2013, www.enform.ca. (Remember if you fall under provincial jurisdiction, the province that the work is being done in is the provincial legislation that needs to be complied with.)
Saskatchewan OH&S Act • Bill 23: An Act to amend The OH&S Act, 1993. In the fall sitting, sections that were not proclaimed (accepted) in 2012 will be re-introduced in 2013 (some sections under review are referenced within this presentation) • Bill 85: this is an omnibus bill. A collection/compilation of provincial labour legislation. Labour legislation such as Labour Standards, OH&S Act etc. will now fall under one Act, The Saskatchewan Employment Act.
Noteworthy amended sections • Section 3(1)(c)(d)Contractors (definition, the party entering into a contract with an employer or self-employed person) now has duties whether or not they are “directing” the activities of the employer or self-employed person and now have duties if they have just “retained” their services. • (under review)
Noteworthy amended sections. • Section 3(1)(f) - Prime contractors (significant duties and responsibilities where multiple employers work on one site, i.e. oil/gas lease) where and how will it be applied? (under review). • Section 3(1)(g) - Supervisors (greater individual duty, directly accountable for the actions of workers being supervised.) (now within the Act ) • Section 8 – Suppliers (responsible under leasing agreement to safely maintain the equipment)
Continued • Section 30 – • Compliance undertaking (written agreement to comply, signed by the employer) • Part 29 Oil and Gas regulations place a duty on various stakeholders (employer, contractor or owner) and these duties are imposed primarily on the “person” with the “greatest degree” of control over the various task that “shall” be complied with. Meaning it would be difficult to “permanently” relieve any party of their responsibility.
Continued • In general all parties have a collective degree of accountability when it comes to ensuring the health and safety of workers and contracting out liability in Saskatchewan is significantly more difficult than some other provinces. • OH&S regulations Part 29, Oil and Gas section, to be one of the first parts of legislation to be reviewed. www.lrws.gov.sk.ca • Get involved!!!!
Continued • Section 24 – Fines (all fines have doubled and where a serious injury and or fatality has occurred the fine can be $1.5 million per count from previously $300,000 per count) • Summary Offence Tickets (tickets can be issued on site, to a worker, supervisor and employer, and/or collectively to all, i.e. flagrant disregard -- possible phase in period) Fines can go from $250 to $1,000. (under review) • Amend the Summary Offences Procedures Regulations to include OH&S officers. How will it be applied? (under review)
Continued • OH&S Division posts the names of those being charged and prosecuted. • Side note: All OH&S training that was done by the OH&S Division has now been turned over to the Saskatchewan WCB.

What’s next? • Enhancing the Safety Culture • Look for opportunities to expand the number of safety professionals within the patch and expand provincial based trainers and auditors • Expand ways to assist new workers either through enhanced education and/or mentoring with direct supervision • Enhance leadership and supervisory skills

Highlights • FACT: 180 fatalities in 2012 – an average of 1 fatality every two days. • FACT: 6,996 injuries in 2012 – an average of 19 injuries per day. • FACT: Saskatchewan has the highest impairment-related traffic fatalities per capita in Canada.
FACT: Average blood alcohol content of drivers involved in fatal collisions is 0.19 – 2.5 times the legal limit. • FACT: For the first time in 2012, distracted driving accounted for more fatalities than impaired driving. • FACT: Excessive speed identified in 31% of fatalities and 15% of injuries.
So, what are we doing? • Enform Saskatchewan is a member of the WorkSafe Highway Safety Committee including RCMP, SGI, WCB, and industry representatives from several industrial sectors. • This Committee has presented to the provincial legislative group working on highway safety initiatives. • Public Service Announcements throughout the summer on distracted driving. TV ad campaigns for distracted driving. • Formulating action plans for 2014 with the focus on reducing road-related accidents, incidents and fatalities. • Raising awareness through “Lunch n Learn” sessions, Information Group Meetings, and trade shows. Slide
